Heard Ld. Counsel for the applicant.
2. M.A No. 350/529/2023 for joint prosecution under Rule 4(5)}(a) of the CAT (Procedure) Rules, 1987 is allowed. The applicants are allowed to pursue the remedy jointly, on payment of individual court fees (postal order/demand draft).
3. The applicant has filed this O.A. under Section 19 of the Administrative Tribunals Act, 1985, seeking the following relief:
a) "Direction upon the respondents, to provide employment on compassionate grounds to the Applicant immediately in accordance with his qualification and if necessary after setting aside Notification dated 09/04/2019 and dated 07/03/2022.
b) A direction be given upon the respondents to produce all the relevant documents of the case before The Hon'ble Tribunal in order to render conscionable justice to the Applicant.
c) To pass such other order or orders and/or further order as to Your Lordships may deem fit and proper for the ends of justice.;"
4. In the instant O.A., the father of applicant No. 1, namely, Sri Hiralal Shaw, who was employed at BSNL in the post of Asstt. Telecom Technician being HR. No. 200007204, Staff No. 203932, expired on 08.05.2021 due to COVID-19 at NRS Medical College & Hospital leaving behind his son (the applicant), a daughter, and, his widow, namely, Smt. Sangita Devi Shaw, i.e. the applicant no. 2 herein.
5. As per the policy for grant of employment on compassionate grounds, the applicant no. 2 herein submitted an application for the same in favour of her son, i.e. the applicant no. 1 herein, along with the requisite documents. However, as per the policy of BSNL as on date, it has been stated vide notification dated 07.03.2022 that compassionate ra we ' pa ' ies ie : et 2 i :
