O R D E R
The present Original Application has been filed by the applicant under Section-19 of the Administrative Tribunals Act, 1985 seeking the following reliefs:-
"i. An appropriate order or direction; quashing of SRO 333 dated 02.08.2018 to the extent of grant of prospective effect only and the respondents be directed by to grant the aforesaid SRO with retrospective effect from 01.01.1996 nationally and monetarily w.c.f. 19.02.2003 on the analogy of Accounts Cadre, Animal/Sheep Husbandry Cadre Pots, Patwaris and Section Officers; ii. Directing upon the respondents to consider the claim of the applicants in the light of judgment passed in case titled "Jammu Kashmir and Ladakh All Departments Clerical Staff Association th. Babu Hussain Malik Vs. State of J&K & Ors", bearing no. TA-861/2020, whereby, direction has been given to quash SRO 333 dated 02.08.2018 to the extent of granting prospective effect only and the respondents were directed to give retrospective effect from 01.01.1996 notionally and monetarily w.e.f. 19.02.2003;

An appropriate order or direction commanding the respondents to give redress to the grievance of the applicants by removing pay anomaly/disparity of clerical staff working in their Government Department in due deference to the decisions arrived at and reduced into writing in the minutes of meeting held on 15th of September 2011 between High Powered group of Government of J&K and Leaders of Union/Association of Employees by revising;

An appropriate order or direction commanding the respondents to perform their duty legitimately cast by making necessary recommendations with regard to removal of pay anomalies/disparities of clerical staff working (pre-revised) notionally w.e.f. 01.01.1996 and monetarily w.e.f. 19.02.2003 in their Government Department so that the decision arrived in the meeting held on 15th September 2011 is implemented in its true spirit and also, to fix the pension of the applicants accordingly;
v. Directing the respondents to pay the arrears of salary and pension to the applicants after removal of pay anomalies/disparities of clerical staff (pre-revised) notionally w.e.f. 01.01.1996 and monetarily w.e.f. 19.02.2003;
Any other relief which this Hon'ble Tribunal in the facts and circumstances of the case deems fit and proper."

At the outset, learned counsel for the applicants' submitted that the applicants would be satisfied and it would meet the ends of justice, if both these OAs are disposed of with the direction to the respondents to consider and decide the cases of the applicants in the light of judgments passed by this Tribunal in case titled "Shamsher Singh and Ors. Vs. UT of J&K and Ors."
