Hon'ble Mr. R. N. Singh, Member (J) M.A. No. 1730/2026 By way of the present MA, the applicants have prayed for certain exemptions.
2. For the reasons given therein in the MA and keeping AKANSHA in view the fact that no objection has been raised by the 2026.04.23 AKANSHA 18:12:09 +05'30' learned counsel for the respondents, the MA is allowed subject to just exceptions.

3. In the present Original Application, the applicants, who are 57 in numbers, have approached this Tribunal seeking the following relief(s):-
"8.1 Pass an order or direction directing the Respondents to consider and decide the representations dated 28.01.2026 and 06.02.2026 submitted by the Applicants by passing a clear, reasoned and speaking order within a time-bound period; 8.2 Pass an order or direction directing the Respondents to allow the Applicants to resume duties and continue to discharge their services as Daily Wager Safai Karamcharis; 8.3 Pass an order or direction directing the Respondents to release and pay wages/salary to the Applicants for the period during which they have been kept out of duty without any speaking order, along with all consequential benefits; 8.4 Pass an order or direction directing that till the decision on the representations of the Applicants is taken, the Applicants be permitted to continue in service and be paid wages regularly as per applicable norms;
8.5 Pass such other or further orders) as this Hon'ble Tribunal may deem fit and proper in the facts and circumstances of the present case and in the interest of justice."8 OA No. 1320/2026 MA No. 1730/2026 MA No. 1731/2026

4. It is the case of the applicants that they have been working under the respondents; however, suddenly they have been disengaged without assigning any reason. Aggrieved by such disengagement, they have preferred joint representation; however, such representation has not been considered and disposed of till date. Thus, the present OA. AKANSHA 2026.04.23 5. Learned counsel for the applicants submits that the AKANSHA 18:12:09 +05'30' applicants are similarly placed, they have prayed for identical relief(s) on common grounds and accordingly, they have filed M.A. No. 1731/2026, seeking permission of the Tribunal to file the present OA jointly.
6. Issue notice. Ms. Nidhi Kumar, learned proxy counsel appearing on behalf of Dr. Divya Swamy, learned counsel for the respondents on advance service, accepts notice.
7. Learned proxy counsel for the respondents is not having any objection if M.A. No. 1731/2026 is allowed.
8. M.A. No. 1731/2026, seeking permission of the Tribunal to file the present OA jointly, is accordingly allowed.

9. However, learned proxy counsel for the respondents has vehemently opposed the OA and submits that the present OA is not tenable.

Learned counsel for the respondents submits that when the engagement of various persons were inspected by the respondents, the respondents required certain documents from the applicants; however, till date, those AKANSHA 2026.04.23 AKANSHA 18:12:09 documents have not been submitted by the applicants, +05'30' therefore, no cause of action has accrued to the applicants.
11. In this regard, learned proxy counsel for the respondents invites our attention to office order dated 22.12.2023 (Annexure A-4), which reads as under:-
"During the post inspection analysis of Ward No. 130 discrepancies in the BMIDs have been found. Therefore, you are hereby directed to provide details in the attached performa along with the copy of first appointment orders within 02 days of issue of this letter, failing which disciplinary action will be initiated against under the rules."
12. Learned proxy counsel for the respondents further invites our attention to office order dated 05.02.2024 (page no. 60 of the OA). The first and the last paras of which read as under:-
"During the scrutiny of documents some BMIDs were found suspected details of which were called for vide letter no. AC/NOZ/MCD/2023-2024/D-811 & 834 dated 22.12.2023 and 29.12.2023, also a team to verify details of such BMIDs was constituted vide letter no. DC/NOZ/MCD/2023-2024/D-181 dated 22.12.2023. Later these 39 BMIDs were also inquired 10 OA No. 1320/2026 MA No. 1730/2026 MA No. 1731/2026 Item No. 06 (C-2) from the office of Director (IT), MCD and it was confirmed that these 39 BMIDs were never been issued by the IT Department, MCD. Even after opportunity given vide letter no. AO/DEMS/NGZ/MCD/2023-24/D-1427 dated 19.01.2024 the documents/requisite details of following BMIDs have not been provided till date.
Accordingly, the above mentioned BMIDs/employees are hereby disengaged from services till the submission of requisite documents.
This issues with approval of Additional Commissioner, NOZ."

When it has been put to the learned counsel for the AKANSHA 2026.04.23 applicants as to when the applicants have submitted the AKANSHA 18:12:09 +05'30' required documents/evidences, learned counsel for the applicants invited our attention to a joint representation dated 28.01.2026 (Annexure A-1).

We have perused the same and find that the same indicates only the names and signatures/names of persons, who had preferred the representations; however, the same in no manner indicates that the applicants have submitted the documents required by the respondents vide their various communications and a few of which are referred hereinabove.

In these facts and circumstances, the present OA is disposed of with liberty to the applicants to individually submit the documents required by the respondents from them within four weeks from today and if such representation along with the requisite documents are 11 OA No. 1320/2026 MA No. 1730/2026 MA No. 1731/2026 Item No. 06 (C-2) submitted by them, the respondents are directed to consider and dispose of the same by passing a reasoned and speaking order(s) as expeditiously as possible and preferably within a period of eight weeks from the date of receipt of such representation(s).
16. Accordingly, the OA is disposed of in the aforesaid terms.
