Order No. 30.08.2023 01. 1. This matter is taken up through Hybrid
Arrangement (Virtual/Physical Mode).
2. Mr.P.C. Jena, learned counsel for the petitioner submits that Petitioner is the wife of OP and the Petitioner has filed an application U/S. 125 Cr.P.C. against OP in Cr.P. No. 175 of 2022 before the learned Judge Family Court, Berhampur for grant of maintenance, but the OP has filed another proceeding U/S. 13 of Hindu Marriage Act, 1955 against the Petitioner for grant of divorce before the learned Judge, Family Court, Bhubaneswar and right now the petitioner is residing at Bhubaneswar and, therefore, the proceeding in Cr.P. No. 175 of 2022 may kindly be transferred to the learned Judge, Family Court, Bhubaneswar.
3. In view of the aforesaid submission, issue notice to O.P. in the TRPCRL by Registered Post /Speed Post with A.D. making it returnable by the next date.
Requisites for issuance of notice against O.P. shall be filed within three working days. Accept one set of process fee.
4. List this matter on 3rd October, 2023.
