HON'BLE MR. JUSTICE SANJEEV PRAKASH SHARMA Order 02/09/2020 Learned counsel for the petitioner(s) submitted that the controversy involved in the present writ petition is about treating the petitioner(s) as Disqualified Directors under Section 164(2)(a) of the Companies Act, 2013. The petitioner(s) have also sought direction to use their Director Identification Number (DIN) and Digital Signature Certificate for the purpose of filing their return.
Learned counsel for the petitioner(s) submitted that the Division Bench of this Court in DB Civil Writ Petition No.4062/2019 (Narendra Kumar Jat Vs. Union of India) has already passed interim order 09.07.2019 and directions have been given to reactivate the Director Identification Number (DIN) and further Digital Signature Certificate is required to be issued in the capacity of the Director to file necessary annual returns to discharge statutory obligations of all the other companies wherein the petitioner(s) is Director.
This Court, as an interim measure, directs the respondents to reactivate the Director Identification Number (DIN) of the (Downloaded on 02/09/2020 at 09:03:19 PM) (2 of 2) [CW-9490/2020] petitioner(s) and Digital Signature Certificate to enable the petitioner(s) to file necessary annual return and also to discharge their statutory obligations.
The interim order, passed by this Court, will remain subject to final outcome of the present writ petition.
Learned counsel for the petitioner(s) is also directed to supply two sets of writ petition in the office of Mr. R.D. Rastogi, learned Additional Solicitor General.
