In the present petition the challenge has been made to the order of punishment whereby the petitioner has been punished with stoppage of two increments with non cumulative effect without following the procedure prescribed under Rule 16(4) of M.P. Civil Services (Classification, Control and Appeal) Rules, 1966.

Learned counsel for the petitioner submits that in number of cases, Coordinate Bench of this Court has already issued notice and interim order has been granted. He has placed reliance on the order dated 30.9.2019 passed in W.P.19116/2019 ( L. K. Pandey Vs. State of Madhya Pradesh) and also an order dated 19.12.2019 passed in W.P. No.17752/2019 (Jagdish Prasad Mishra Vs. The State of Madhya Pradesh).

Considering the aforesaid submissions and in order to maintain parity, issue notice to the respondents on payment of process fee within two weeks or alternatively the respondents can be served by e-mail also.

Till the next date of hearing, the impugned order dated 10.2.2020 (Annexure P/1) shall remain stayed so far as it relates to the petitioner.
