% 09.11.2022 CRL.M.A. 22859/2022 This is an application seeking early hearing of the petition. On the last date of hearing, none appeared for the petitioner and the matter was re-notified for 24.01.2023.

It is stated in the application that the petitioner had sought the date as 10 th , 15th , 21st and 28th November, 2022, however, the matter was listed on 31.10.2022 and hence the petitioner could not appear.

In view of the submissions made by learned counsel for the petitioner and for the reasons stated above, the application is allowed and the petition is taken up for hearing today.

The application is disposed of accordingly.

This is a petition seeking quashing of Criminal Complaint No. 5470/2020 titled „M/s V K Mittal & Sons (HUF) vs. Modex International Securities Ltd. & Ors.‟ qua the petitioner pending before the learned trial Court preferred under Section 138 and 142 of the Negotiable Instruments Act, 1881 and the subsequent proceedings emanating thereto.

It is stated by learned counsel for the petitioner that the petitioner even though was a Wholetime Director, was not a signatory to the cheque nor had any role in day-to-day functioning of the respondent No.2 company.

Let notice be issued to the respondents by all modes including electronic on the petitioner taking requisite steps within two days from today returnable on 30.11.2022, as the next date before the learned trial Court is 03.12.2022.
