                                    ORDER

02.08.2022 When this matter was taken up for consideration, Mr. Ali Mohammad Dar, learned counsel appearing on behalf of petitioner made reference to the counter affidavit filed by the respondents through Divisional Personal Officer, Northern Railways, Ferozpur, Punjab.

Counter affidavit has been filed by Mr. S. A. Naik, learned counsel and his name is only shown in the cause list but he is not present, therefore, need arose to seek assistance of Mr. T. M. Shamsi, learned ASGI.

Mr. T. M. Shamsi, learned ASGI on appearance submits that the subject of the writ petition being a service dispute, therefore, comes within the jurisdiction of Central Administrative Tribunal, however, counsel for the petitioner objects the same and submits that the subject of the writ petition is not a service dispute, as such, not amenable to the jurisdiction of Central Administrative Tribunal.

Be that as it may, let Mr. T. M. Shamsi, learned ASGI get a copy of paper book from the Registry during the course of the week, so as to enable him to assist the Court on the next date of hearing, as the counsel for the petitioner is pressing hard for disposal of the case without any further delay.
