Heard Sri Anuj Srivastava, learned counsel for the petitioner and Sri Sanjeev Pandey, learned Standing Counsel appearing for the State-respondents.

The present petition has been filed seeking a direction to respondent no.2/Nayab Tehsildar, Mandal Basti, Tehsil Soharthgadh, District Siddharthnagar to decide the Case No. 03987 of 2017, under Section 34 of the U.P. Revenue Code, 2006, within a stipulated time period.

Counsel for the petitioner has referred to the order sheet of the case which has been filed along with this petition to contend that although various dates are being fixed for hearing but for some reason or the other the matter is being adjourned and the delay in disposal of the said case is causing undue hardship to the petitioner. Accordingly, a prayer is made to expedite the proceedings.

Learned counsel appearing for the State-respondents has no objection to the prayer so made.

Having regard to the aforementioned facts and circumstances and without expressing any opinion on the merits of the case, the present petition is disposed of with an observation that the court concerned would be expected to make an endeavor to decide the aforesaid case in accordance with law, expeditiously preferably within a period of three months from the date of production of certified copy of the instant order, provided there is no other legal impediment.
