                03.            1.         This matter is taken up through hybrid mode.

2. Order dated 26th December, 2022 (Annexure-6) passed in CS No.1043 of 2019 is under challenge in this CMP, whereby learned Senior Civil Judge (LR), Bhubaneswar rejected an application under order I Rule 10 (2) CPC filed by the Plaintiff- Petitioner to implead Commissioner, Bhubaneswar Municipal Corporation and Vice-Chairman, Bhubaneswar Development Authority as Defendant Nos. 3 and 4 to the suit.

3. In course of hearing, Mr. Sinha, learned counsel for the Petitioner submits that appropriate steps have been taken for amendment of the plaint. Hence, he does not want to press the CMP at this stage.

4. Hence, this Court, without expressing any opinion on the merits of the petition for amendment, disposes of the CMP as not pressed.
