CORAM: Hon'ble Mr. Justice G.S. Sandhawalia

Present:- Mr. Gautam Kailey, Advocate for the petitioners

                                        ****

G.S. Sandhawalia, J. (Oral)

1. The petitioners are seeking anticipatory bail in FIR No.507 dated 11.10.2012 under Sections 148, 149, 324, 506, 307 IPC registered at Police Station City, Palwal.

2. The petitioners who are brothers are named in the FIR and allegations are that petitioner no.2 was carrying knife and attacked the complainant on the chest. A perusal of the medical record produced by the counsel for the petitioners himself shows that the Board of Doctors were of the opinion that the injury sustained to the person is dangerous to life, if not treated in time. The discharge summary dated 15.10.2012 of Om Spero Hospital, Delhi Mathura Road, Palwal also shows that complainant Lalit Tewatia was admitted with complaints of stab injury on abdomen at around 4.15 P.M. on 9.10.2012.

3. Keeping in view the fact that the petitioners alongwith others have attacked the complainant at a public place and the injury is grievous in nature and dangerous to life and the weapon of offence is to be recovered by the Investigating Agency, no case for grant of anticipatory bail is made out.

4. Accordingly, the Criminal Misc. Application is dismissed.
