1. We have perused the appeal seeking temporary bail filed by the applicant Mohan Madhav through jail authority and heard the learned Special Public Prosecutor and Standing Counsel Mr.Kshitij Amin with Mr.Sandeep Sadavrate, appearing for and on behalf of N.I.A.

2. The affidavit in reply tendered by the Special P.P. is ordered to be taken on record.

3. The appellant accused Mohan Madhav and others have been charged under Sections 489A, 489B, 489C, and 489D read with Sections 34 and 120B of IPC. After their arrest, and upon completion of investigation, and filing of the chargesheet, they put on trial. The learned Special Court after framing of the charge, proceeded to record the evidence of the prosecution and the trial is on crucial stage. In these background facts, the appellant A4, sought temporary bail, on the ground that since long, he is in custody and in the family, there is no responsible Page 1 of 2 Uploaded by RAKESH M KOSHTI(HC00950) on Tue Aug 05 2025 Downloaded on : Tue Aug 05 22:32:01 IST 2025 NEUTRAL CITATION R/CR.A/1629/2025 ORDER DATED: 04/08/2025 undefined person to look after his wife and mentally retarded son aged about 35 years and therefore, he may be released on temporary bail for a period of 30 days. The learned Special Court in Para-6 of the order dated 18.04.2025 while rejecting the application, has observed that the trial is at the crucial stage and on earlier occasion twice the orders were passed, but somehow the accused could not avail that benefit.

4. We have carefully examined the reasons mentioned in the application by the appellant and perused the contents of sworn affidavit of the officer of the authority.

We are of the considered opinion that having regard to the nature and gravity of charge, and as argued by the other side that there are all possibilities fleeing from the justice, we do not find any ground to exercise our discretion in favour of the appellant. It is relevant to note that twice with police escort, the orders were being passed by the Trial Court, but the accused failed to avail the benefit of the orders. Thus, when the trial is at the crucial stage and reasons mentioned above, no case is made out as prayed for.

6. Accordingly, the appeal fails and is hereby dismissed.
