The petitioner has preferred this writ petition under Article 226/227 of the Constitution of India for issuance of writ of mandamus for directing the respondents to grant the pay scale to the petitioner as has already been allowed by the respondents-department vide order dated 16.07.2015 (Annexure P-1) passed by this Court while replying in COCP NO. 3131 of 2014 in CWP No. 3365 of 2012.

Learned counsel for the petitioner contends that the co-employees of the petitioner had filed a writ petition CWP No. 3365 of 2012 and as a consequence thereof, the respondents were directed to release the pay scale only to the petitioners of the said petition. The petitioner in the present petition is a similarly situated employee alike the employees who have got the pay scale.

Now, the short prayer of the petitioner is that the respondents may be directed to decide the legal notice dated 28.05.2016 (Annexure P-2) within a specific time frame.

In the circumstances, without issuing notice to the respondents, the present writ petition is disposed of with a direction to the respondents, to decide the legal notice dated 28.05.2016 (Annexure P-2) of the petitioner. It is 1 of 2 ::: Downloaded on - 21-01-2017 20:10:25 ::: 2 CWP No. 672 of 2017 ordered that if it is found that the petitioner is entitled to the said benefit as claimed by him, the same be released forthwith and if the said benefit is denied to the petitioner, speaking order shall be passed within two months from the date of certified copy of this order.
