We have heard the petitioner in person.
The petitioner is a member of reserved category joined service in the Rajasthan Police Service in the year 1977 and was granted selection scale of RPS against the vacancy of 1985-86 and his grievance is that Sh. BP Verma and Ms. Badam Bairwa they were appointed to the IPS cadre and he being senior to them has been deprived of his right of fair consideration for appointment to the IPS cadre & stood retired from service on 30.04.2002.
Before us the order dt.11.12.2006 has been placed that discloses that Ms. Badam Bairwa and Sh. BP Verma both are members of reserved category and promoted in selection scale in RPS against the vacancy of the year 1985-86 & 88-89 and were appointed to IPS cadre in the year 2004 and the petitioner stood retired from service in April,2002 and even if those who were junior in the selection scale of RPS at least the petitioner cannot have a right of consideration qua them as both of them appointed to IPS cadre much after he stood retired from service from the RPS cadre. Even officer PR Javeria who was promoted/appointed in Supertime Scale of RPS he too was appointed in IPS cadre in 2004 and as regards Sh. Dhaiya against whom also the petitioner has vehemently contended was appointed to supertime scale of RPS and stood retired from service in August,2001 itself. The petitioner is unable to justify despite the question being put to him as to who are the officers in selection scale/supertime scale of RPS and junior to him in the reserved category, appointed to IPS cadre while he retired from service.
The petitioner is unable to justify and to place documentary evidence on record of the members of RPS junior to him in the cadre of selection scale/supertime scale have been appointed to IPS cadre and the Tribunal has also considered in detail and find no error in the decision making process as prayed for by the petitioner.
We have heard the petitioner in person and do not find any manifest error committed by the Tribunal which may require our interference.
Consequently, the writ petition is devoid of merit and dismissed.
