RESPONDENTS
Petition under Article 226 of the Constitution of India is filed praying that
in the circumstances stated in the affidavit filed therewith, the High Court may
be pleased to pass an order or a Writ, particularly one in the nature of Writ of
Mandamus directing the respondent Nos. 1 to 6 to declare the registration of
the society as "Tele Communication Department Employees Co-operative
House Building Society Ltd No. P - 1459, Kurnool" as illegal and void for
violation of the provisions of law as laid down in the AP Co-Operative
Societies Act, 1964 and Rules thereof and consequently pass an order
declaring the present Executive Committee also as illegal and void and
consequently the resolution dated 12-04-2021, "It is unanimously passed by
the Meeting of the Society Board of Directors to allot half of the plot No.1
situated in Garudadri Nagar to P. Ramadasu, Society member and plot No.2
situated in Garudadri Nagar to Sri E. Thirupathaiah and also the resolution
dated 01-08-2021 passed by the Society in the General Body Meeting under
the Chairmanship of the P. Ramadasu the than president for effecting
registration of half of the plot No.1 (24X75) in an extent of 1800 Sq.Feets or
200 Sq.Yards situated in Sy.No.642 approved as L.P.No.332 of 82 in
Garudadri Nagar for an amount of Rs.26,40,000/- being the highest bid
amount quoted by the respondent No. 14 Mala Savari being the highest bidder
as illegal and void and be further pleased to pass such other order or orders
that the hon ble Court may deem fit and proper in the circumstances of the
case;

Petition under Section 151 of CPC is filed praying that in the
circumstances stated in the grounds filed in support of the petition, the
High Court may be pleased to pass an interim order suspending the
operation of the Present Executive Committee from functioning as such as it
was said to have been elected on the basis of the Society, the registration of
which was illegal and void since it was violative of the provisions of the AP
Cooperative Societies Act and Rules of the Act as illegal and void and be
further pleased to pass such other order or orders that the Hon'ble Court may
deem fit and proper in the circumstances of the case. Pending disposal of
WP No. 13296 of 2024, on the file of the High Court.

Petition under Section 151 of CPC is filed praying that in the
circumstances stated in the grounds filed in support of the petition, the
High Court may be pleased to pass an interim order directing the unofficial
respondent Nos. 12, 13 and 14 not to change the physical features of the said
plots registered in their favour by making any type of constructions or
structures thereon, pending disposal of WP No. 13296 of 2024, on the file of
the High Court.

and upon hearing the arguments of Sri Y.Koteswara Rao, Advocate for the
Petitioner, Deputy Solicitor General of India for the Respondent No.1, learned
GP FOR CO-OPERATION SOCIETY for respondent Nos.2, 3, 5 & 6, learned
GP FOR REVENUE for respondent No.4, Sri B. SATYANARAYANA, Standing
Counsel for respondent Nos.7 to 13 , the Court made the following:
ORDER:
"At request of learned Assistant Government Pleader, for filing counter affidavit, post after two (2) weeks.
Interim order granted earlier in WP No. 13296 of 2024 is extended for a further period of six (6) weeks."
