Ct.No.34 b.das Rejected C.R.M. (DB) 588 of 2025 In Re : An application for bail under Section 483 of BNSS, 2023 filed in connection with Beniapukur Police Station Case No.326 of 2021 dated 18.08.2021 under Sections 120B/489A/489B/489C/489D of the Indian Penal Code.

The bail prayer of the petitioner was turned down on merits on earlier occasions.

Learned counsel for the petitioner submits that the petitioner is in custody for 3 year 8 months and trial has not progressed much after the earlier rejection.

Learned counsel for the State submits that there have been instances when the prosecution was unable to produce witness and also when the petitioner has sought adjournment before the learned trial Court.

Learned counsel submits that 4 more witnesses are left to be examined and trial shall be concluded within three months from the next date of evidence fixed before the learned trial Court subject to co operation of the petitioner.

Considering the material available on record and prima facie involvement of the petitioner the prayer for bail is rejected at this stage.

The learned trial Court is directed to take the proceeding to its logical conclusion in the light of the submission made on behalf of the State without granting any unnecessary adjournment to either of the parties, in accordance with law. It is expected that the prosecution as well as the defence shall render utmost co operation in expeditious conclusion of the trial.

The application for bail is thus disposed of. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
