ORDER
1. The appellant filed an application under the Right to Information Act, 2005 (RTI Act) before the Central Public Information Officer (CPIO), M/O. Railways, Indian Railway Catering & Tourism Corp. Ltd., New Delhi seeking following information:-
1. "Copies of technical evaluation committee decision, copies of price bid comparison sheet and copy of MSE registration certificate of the tender awardee from 28.01.2016 till date.
2. Name and designation of the official responsible for implementation of Public Procurement Policy, 2012 under MSME Act, 2006 for subject tender.
3. Name, designation and email address of the official responsible for implementing CVC guidelines dated 10.12.2004 for subject tender.Page 1 of 4
4. Name, designation and email address of the official violating guidelines mentioned at Sr. Nos. 2 and 3 for the subject tender.
5. Name, designation and email address of the controlling authority who is accountable to take action upon erring employee for violation at Sr. Nos. 2 and 3.
6. Details of action taken by controlling authority upon erring employee till date. If no action being taken then reasons on record be made.
7. Speed post number, date of dispatch and page from the copy of outward file proving that the unopened price bid of the firm M/s. Aerographic Papers Private Limited has been returned.
8. File noting of his current RTI dated 17.05.2017."
2. The CPIO responded on 30.06.2017. The appellant filed the first appeal dated 12.07.2017 which was disposed of by the first appellate authority on 27.11.2017. Thereafter, he filed a second appeal u/Section 19(3) of the RTI Act before the Commission requesting to take appropriate legal action against the CPIO u/Section 20 of the RTI Act and also to direct him to provide the sought for information.
Hearing:
3. The appellant, Mr. Varun Krishna attended the hearing in person. Mr. U. K. Singh Gaharwar, JGM and Mr. D. S. Niranjan, JGM participated in the hearing representing the respondent in person. The written submissions are taken on record.
4. The appellant stated that the respondent should be directed to provide him the e-mail address of the controlling authority as mentioned in point no. 5 of the RTI application.
5. The respondent agreed to provide the e-mail address of the controlling authority to the appellant as mentioned in point no. 5 of the RTI application, within a period of 15 days from the date of receipt of this order. Decision:
6. This Commission directs the respondent to provide the official e-mail address of the controlling authority to the appellant as mentioned in point no. 5 of the RTI application, within a period of 15 days from the date of receipt of this order.
