Leave granted to add husband who had been already been there as applicant no. 2, as the applicant no. 1. Amendment to be carried out forthwith.
2. Learned advocate for the applicants and the respondent no. 2 place on record joint consent terms. Those are taken on record and marked 'X' for the purpose of identification.
3. The learned advocates unanimously submit that as per the settlement, the parties have resorted to Khula. They have also placed on record the Khulanama.
4. Since the offence was registered due to the matrimonial dispute and now that the parties have arrived at a compromise and the 2 Cr. Appln. 171 / 2023 respondent no. 2 is giving consent for quashment, the application is allowed.
5. Ms. Pratibha Suryawanshi was appointed to represent the respondent no. 2. We quantify her fees at Rs.3,000/- (Rs. Three Thousand) [ SHAILESH P. BRAHME ] [ MANGESH S. PATIL ] JUDGE JUDGE arp/
