{Per Hon'ble Mr Justice R. Kantha Rao, Judl. Member) Heard the learned counsel appearing for the parties.
2. Since the issue involved in all the 5 O.As Is similar, these OAs are disposed of by the following common order.

The O.As are filed seeking to declare the action of the respondents while issuing the orders in M {HRD} Memo No.3/2013 dated 23.3.2013, promoting the personnel as Construction Supervisors Trade-wise instead of grade-wise, without taking into consideration the dates of joining and the assignment of the seniority of the applicants and the action in nat considering the cases of the applicants for their promotion as Canstruction Supervisors as illegal, arbitrary and unconstitutional and violative of Articles 14, 16 & 21 of the Constitution of India and consequently direct the respondent to consider the cases of the applicants for promotion to the post of Construction Supervisors in the existing vacancies with all conseguential benefits such as arrears of salary, seniority, ete.
a. The undisputed facts in the O.As are that the applicants were initially appointed as Construction Assistant 'B' in different trades in ar around 1990. Thereafter, they were promoted to the grade of Construction Assistants 'C' in their respective trades in years ranging from 2006 to 2008. Supporting documents are annexed to the O.As. it is submitted by the applicants that the respondents have ordered enbloc-year-wise promotions ae EHO, es by fixing a cut-off date in the ve ~" grade, the seniority was fixed with regard to grade in which the employees . were working and Trade has no significance as all the employees were working in the very same grade.
5. it is submitted by the applicants that as per Gazette No.10 dated May 11, 2802, the Construction Assistant 'C' Grade personnel who have completed the 5 years of qualifying service are eligible to be prornoted as Deputy Construction Supervisor. ft is further submitted that as per the letter dated 18.2.2010 of Ministry of Defence addressed to the Director General, ATV Programme, Department of Defence Research & Development, New Delhi, the pasts of Deputy Construction Supervisor in the pre-revised pay scale of Rs.5000-8000/- and Construction Supervisor in the pre-revised pay scale of Rs.5500-9000/- are merged into one grade af Group 8' (Non-Gazettad) Construction Supervisor in the revised pay band-2 (Rs. 9300-34800 + Grade Pay of Rs.4200/-}, &. itis submitted by the applicants that the respondents have issued orders in MUHRD) Maemo dated 23.53.2019 promoting 12 Construction Assistants 'C' of different trades as Construction Supervisors. However, the applicants were not considered for promotion to the grade of Construction Supervisor. it is the main contention of the applicants that the promotions were ordered trade-wise bypassing the date of joining and the seniority position in the feeder grade of Construction Assistant 'C. it is submitted that the applicants have submitted individual representations requesting not to order Trade-wise promotions in violation of Recruitment applicants filed the present O.A.
7. It is contented by the applicants that as per the joining instructions far ATVP Technical Cadre personnel, Multi-Skill Trade Structure is as follows:

9. itis contended by the nts in their reply that while granting promotions from Construction Assistant "C to Construction Supervisar, the averall futuristic requirements of the organizations were kept in view. It Is not denied by the respondents that the applicants are eligible for consideration and are considered for prornotion by DPC. However, it is their contention that the aspect of grade-wise promotion will totally upset the workers to supervisors ratio ina particular trade. It is further submitted that as per SRO 98 dated 17.4.2002 Column 5, the promotions are to be granted based on selection-curn-seniority and nowhere it Is stated thet it should be implemented grade-wise. It is further submitted that the joining instructions which were issued on 5.4.2000 have since been replaced by the SRO 98. It is contended by the respondents that even though the terminology of Multi Skill Trade Structure (MSTS) js used, personne! from Welder Trade, Pipe Fitter, etc. cannot do each other's job and hence promotions simply basing on the grade results in a mismatch in the trade- wise distribution which dees not cater to the future requirements of the organization. it is further submitted by the respondents that even though the pay structure of all the four categories may be the same but the duties discharged by them are totally different and cannot be interchanged. Therefore, trade-wise seniority has been taken into consideration and promotions have been effected accordingly for even distribution of supervisors against different trades and to maintain proper ratios between supervisors and workers trade-wise. it is further submitted by the respondents all the vacancies in the grade of Construction Supervisor are filled up following reservation policy.

13. The short question that falls for consideration in these O.As is as to whether the promotions to the post of Construction Supervisor are to be:
made prade-wise or trade-wise,

Normally the seniority of an employee would be determined basing on the date of entry into service, however subject to the merit if any required to be considered among the candidates at the time of selection, in all the cases the relief sought for by the applicants is that the promotions were sought to be made grade-wise instead of trade-wise by taking into consideration the date of entry into service. As rightly contended by the applicants the trade would be significant only at the time of recruiting the candidates but not at the time of granting promotion. As per the SRO No.98/2002 dated 17.04.2002 read with the Presidential Order dated 03.08.1999 the eligibility criteria to be fulfilled for promotion to Construction Supervisor is as follows :
"Construction Assistant - C with S years of regular service in the grade subject to the passing of departmental qualifying examination."

Therefore, there is any amount of force in the contention of the applicants that the grant of promotions to the grade of Construction supervisor has to be granted on the grade-wise seniority and not based on trade-wise seniority under the principle of selectlon-cum-seniority. Itis alsa pecifie rules governing the Sh Sees well settied that in the absence of an promotion, the seniority among the persans holding similar posts in the same cadre has to be determined on the basis of length of service and not an fortuitous circumstances.
14. identical issue was determined by the CAT. Emakulam Bench in OA.10/2011 taking the view that for effecting promotions the grade-wise seniority has to be taken into ronsideration but not the trade-wise seniority, when there is no provision in the recruitment rules of Technical Assistants which provides for inter-se seniority amongst the different disciplines.
18. in view of the above, all the OAs succeed and they are allowed, There shall be no order as to costs.
