1. In O.M.P. (COMM) 42/2019 & O.M.P. (COMM) 43/2019 the Petitioner seeks to challenge the award dated 20.07.2018.
2. Vide Order dated 31.07.2023, a Co-ordinate Bench of this Court rejected the Petition under Section 34 of the Arbitration Act and upheld the Award. The said Order was taken up in appeal in FAO(OS)(COMM) 180/2023 wherein the Division Bench of this Court vide Order dated 17.05.2024 set aside the Order dated 31.07.2023 and remanded the case back to the learned Single Judge for deciding the case afresh by giving reasons. The said Order was taken up to the Apex Court by the Respondent No.2 by filing SLP(C) 14936/2024. The Apex Court vide Order dated 20.06.2024 upheld the Order dated 17.05.2024.
3. It is pertinent to mention that the Respondents in O.M.P. (COMM) 42/2019 & O.M.P. (COMM) 43/2019 had also made a similar challenge to the award by filing O.M.P. (COMM) 450/2018 & O.M.P. (COMM) This is a digitally signed order.

During the course of the arguments by the learned Counsel for the Petitioner it was brought to the notice of this Court that the said order has been challenged by the Respondent and the same is pending before the Division Bench of this Court in FAO(OS)(COMM) 171/2024 & FAO(OS)(COMM) 173/2024 which are listed on 20.01.2025 before the Division Bench.
4. This Court is of the opinion that in order to avoid conflicting decisions it would be expedient for this Court to await the decision of the Division Bench in FAO(OS)(COMM) 171/2024 & FAO(OS)(COMM) 173/2024.
5. List on 17.02.2025.
6. It is made clear that the matter is not being kept as part heard.
