ORAL JUDGMENT
Date : 07-01-2022 The matter is heard via video conferencing due to circumstances prevailing on account of the COVID-19 pandemic.
2. State counsel accept notice for respondent nos. 1 to
8. Service of notice to 9th respondent is dispensed.
3. In the instant petition, petitioners have prayed for following reliefs:-
"(1) That the instant application is directed for passing necessary order or orders, Patna High Court CWJC No.9696 of 2020 dt.07-01-2022 5/6 direction as nature of the case may require commanding the respondent authorities to regularize services of the petitioners like other similarly situated persons so as not to be discriminated for absolutely no wrong on their parts by way of issuing writ of mandamus in as much as directing the concern authorities not to give effect to the contract, made between respondent no. 2 and 9 (A non Governmental Organization) whereby services of the petitioners are virtually at stake by issuing writ of Prohibition as also declaring the policy decision, made by respondent no. 1 (contract between respondent no. 2 and 9) where under petitioners are instructed to render their services, though are virtually on the verge of retrenchment be declared to be per se bad as the same is disastrous, strangent, unreasonable and unfair as also quashing the advertisement/ letter dt. 08.06.2020 published by respondent no. 9 for filling the posts and thereby debarring persons like petitioners to retain their services by way of issuing writ of certiorari."
4. Petitioners were stated to have been appointed on contract basis in the year 2012. In the light of their appointment, they have sought for regularization of their services. In support of the prayer, learned counsel for the petitioners pointed out Annexure-5 and further representation at Annexure-3.

Concerned respondent is hereby directed to examine whether petitioners are entitled for regularization or not in the light of Apex Court's decision rendered in the case of Secy., State of Karnataka V. Uma Devi reported in (2006)4 SCC page Patna High Court CWJC No.9696 of 2020 dt.07-01-2022 6/6 1 passed in CWJC No. 16 of 2021 read with full bench decision of this Court in case of Ram Sevak Yadav & Another Vs. The State of Bihar & Others reported in 2013(1) PLJR 964 passed in CWJC No. 267 & 472 of 2010 read with policy decision of the State Government relating to regularization of contract employees (appointed by the State Government or its sub- ordinates). Such decision shall be taken in passing speaking order. The above exercise shall be completed within a period of six months from the date of receipt of this order and the decision shall be communicated to the petitioner.
6. With the above observations, the instant petition stands disposed of.
