WRIT PETITION NO.10579 OF 2021
ORDER:
This writ petition is filed under Article 226 of the Constitution of India seeking the following relief:
"To issue Writ of Mandamus declaring the action of the respondent authorities in not deleting the petitioners property in an extent of Ac 5 00 cents in Sy No 1047/1 of Tallapaka Revenue village Rajampet Mandel Kadapa District from the list of prohibited properties U/Sec 22A la of Registration Act 1908 as highly arbitrary illegal null and void and against norms of public policy and principles of natural justice and violative of fundamental rights apart from Article 300A of Constitution of India and consequently to direct the respondent authorities to delete the above said property from the list of prohibited properties pursuant to the reports of the Tahsildar 12.12.2018 and 16.02.2019 and to effect the registrations in respect of the subject land."
Though the petitioner made several allegations against the respondents, during hearing, learned counsel for the petitioner requested this Court, without touching the merits of the case, to issue a direction to the respondents to dispose of the representation of the petitioner dated 29.11.2018.
Learned Assistant Government Pleader for Revenue readily agreed to dispose of the representation of the petitioner dated 29.11.2018, if any pending with the authorities.
In view of the submission of the learned Assistant Government Pleader for Revenue, I need not decide the truth or otherwise of the allegations made in the petition. This Court is conscious that no such direction be issued, in view of the judgment of the Apex Court in "The Government of India v. P.Venkatesh1", wherein the Apex Court held that such orders may make for a quick or easy disposal of cases in overburdened adjudicatory institutions. But, they do no service to the cause of justice. As the learned counsel for the 1 2019 (8) SCALE 544 MSM,J WP_10579_2021 2 petitioner himself requested to issue a direction to dispose of the representation dated 29.11.2018. I find no other alternative except to issue such direction.
In the result, the writ petition is disposed of, directing the respondents to dispose of the representation dated 29.11.2018 within one month from today, in accordance with law. No costs.
Consequently, miscellaneous petitions pending, if any, shall also stand closed.
