01. 1. Heard the learned counsel for the Petitioners and the State.
2. By means of this application, the Petitioners seek grant of bail U/s.438 Cr.P.C. in apprehension of arrest for their alleged involvement in the offences U/s.341/353/294/506/427/34 of IPC read with Section 3 of the PDPP Act in connection with Rajkanika P.S. Case No.128 of 2024 corresponding to G.R. Case No.339 of 2024 pending in the court of the learned J.M.F.C., Aul.
3. Keeping in view the nature of allegations, the circumstances appearing, the seriousness and gravity of the offences, while this Court is not inclined to grant anticipatory bail, it is directed that in the event the Petitioners surrender and move for bail in connection to Rajkanika P.S Case No.128 of 2024 within a period of three weeks hence, they shall be admitted to bail on such terms and conditions as would be deemed just and proper by the said court Page 1 of 2 // 2 // subject to deposit a sum of Rs.1,000/- (Rupees one thousand) each in the manner to be directed by the learned court concerned.
4. It is made clear that the court shall verify the criminal antecedent in respect to the Petitioner Nos.1, 3, 4 and 5. In case antecedent is noticed, the order of this Court shall not be given effect to and the court shall be free to deal with matter of bail according to its merit without further reference to the present. The ABLAPL is disposed of accordingly.
