In the absence of acceptance of bid offered by the plaintiff by the competent authority, there was no concluded contract in respect of the plot in question, which is evident from the letters wherein the third defendant (Housing Commissioner of the Board) had rejected the bid amount deposited by the plaintiff and the same was 4 refunded to him by way of demand draft, which is an undisputed fact.

Further, even assuming that the Assistant Housing Commissioner had the authority to supervise and conduct the public auction and the authority to accept the final bid of the plaintiff in relation to the auctioned plot, it is also an undisputed fact that he did not accept the bid of the plaintiff in writing and communicated the same to him. Hence, neither the Housing Commissioner nor the Assistant Housing Commissioner had accepted the proposal in writing. There was also no communication regarding acceptance of the proposal of the highest bid of the plaintiff as required under Section 3 of the Contract Act, 1872. Therefore, there was no concluded contract in favour of the plaintiff in relation to the offer made by him, whose offer was highest in public auction. Further, the unaccepted offer of the plaintiff does not create any right or any obligation on the part of the defendant to execute the lease deed. Therefore, no legal right accrued in favour of the plaintiff to invoke the remedy available under Section 34 of the Specific Relief Act, 1963. Hence, the suit filed by the plaintiff seeking declaratory relief as prayed in the plaint is wholly misconceived and is not maintainable in law as the plaintiff did not acquire legal right in respect of the plot in question. The above important factual and legal aspects have not been examined in proper and constructive manner either by the trial court or by the High Court. BATHLA esa ekuuh; jk"Vªh; vk;ksx us fuEu fu/kkZfjr fd;k gS %& Perusal of complaint and proceeding of auction dated 9.11.2004 reveals the bed price of Rs. 11.86 lakh was not considered satisfactory by the Auction Committee; so, bid was withdrawn and all sites were withdrawn from auction and Presiding Officer of the Auction Committee cancelled auction. Once auction has been cancelled and bid of complainant was not finalized complainant attains no right to get disputed property in auction. Learned State Commission has wrongly observed that OP had no right to cancel bid or withdraw property from auction, when process of auction started and bid attains finality. Admittedly, bid did not attain finality and looking to mal practice, Auction Committee withdrew bid and cancelled auction proceedings. Learned State commission again wrongly observed that once the bid had attained finality, OP cannot be allowed to act in an arbitrary manner in cancelling bid-Record reveals that bid did not attain finality and auction was cancelled as bidders pooled and indulged in mal-practice. OP had every right to cancel bid and was not bound to accept bid merely because it was on higher side than reserve price.
