Begusarai, Bihar has forwarded incorrect and misleading information to the Commission and requested for reinvestigation of the matter and action against Superintendent of Police, Begusari, Bihar.
"Perused complaint dated 3.10.2022. Since Commission has already observed that the complainant had filed a separate complaint before the court of Learned CJM, Begusarai vide No. 492/2020 against the officers named in the report which is pending before the said Court. Therefore, without the order of the Court any other action, in this case, may not be initiated. Matter is already sub-judice before competent Court, hence, no action is required on the complaint. The complainant may be informed accordingly." A copy of the direction of the Commission is enclosed (Annex-III).
4 The appellant letter was primarily addressed to Joint Secretary, Home Department, Govt of Bihar with copy addressed to many others including NHRC and the PIO duly informed the appellant that there is reference of NHRC case and gave details about the case which was closed by Commission being sub-judice. It may also please be noted that as per section 9(xi) of NHRC (Procedure) Regulation, 1994 (Annex IV), whenever the matter is sudjudice, the complaint is not ordinarily entertainable and the Commission may dismiss it in limini. As such it is humbly submitted that PIO in the instant matter had discharged the onus of furnishing information as mandated under the provisions of RTI Act."
