... For the State.
Heard the learned counsel appearing on behalf of the petitioners as well as the learned counsel appearing for the State.
Perused the case diary.
This is an application for anticipatory bail by the petitioners, who apprehend their arrest in connection with a case relating to offences punishable under Sections 447 / 324 / 326 / 325 / 308 of the Indian Penal Code read with Sections 25/27 of the Arms Act and Sections 3 / 4 of the Explosive Substances Act, registered vide, Tehatta P.S. Case No. 801 of 2010 dated 13th December, 2010.
We have gone through the case papers and having regard to the nature of injury sustained by the victim as it appears from the injury report, we are inclined to consider the application for anticipatory bail. Furthermore, we do not think that this a case where custody of the petitioners is necessary.
2CRM 2395 of 2011 Accordingly, it is directed that in the event, petitioners are arrested for having committed offence under Sections as aforesaid, they shall be released on bail upon furnishing P.R. Bond of Rs. 5,000/-,each, with one surety of the like amount each, on condition that they shall attend the concerned police station daily between 10 a.m. to 12 noon for period of 7 days and thereafter as and when required for the purpose of investigation.
Thus, the application for pre-arrest bail stands disposed of.
