O R D E R
The applicant has preferred this Original Application, seeking direction to the respondents to consider her case for grant of appointment on compassionate ground.
2. The learned counsel for the applicant submitted that mother-in-law of applicant, while working with the respondents, died in harness on 07.01.2011. After that her husband died on 06.02.2015. Since applicants father-in-law had died long back, now in the family only remaining members are the applicant and her four month old daughter. There are no other family members in the family as applicants husband did not have any brother and sister.
3. The applicants husband had also applied for compassionate appointment, but before he could be given employment he died in road accident. Therefore, the applicant being dependent family member of the deceased employee, deserves to be considered for grant of compassionate appointment. In this regard, reliance has been placed by the applicant on judgment of Honble High Court for Rajasthan at Jodhpur passed in S.B. Civil Writ Petition No.9177/2010 (Smt. Pinki Vs. State of Rajasthan & ors.)
4. In Smt. Pinki (supra), after death of deceased employee, the remaining family members were Smt. Suwa Devi (mother of deceased), Smt. Jimiya Devi (wife of the deceased and mother-in-law of the petitioner), Smt. Pinki (petitioner), Baby Krishna and Baby Rampriya (both daughters of the deceased petitioner). Thus, there were directly dependent members of the family of deceased employee as mother and wife of the deceased employee were there. Since there was no other surviving employable member in the family, the respondents were directed to consider the case of daughter-in-law for grant of compassionate appointment so that family of deceased Government employee does not suffer distress. However, in the present case, there is no surviving member of family of deceased employee who could be considered to be directly dependent upon the salary of the deceased employee, and therefore, likely to suffer distress on her death. Thus, compassionate appointment to the applicant will serve only her and no other directly dependent member of the family of deceased employee.
5. In these circumstances, I do not find any justification for grant of reliefs prayed for by the applicant in this Original Application. Thus, the Original Application is dismissed in limine.
