2 9.2.2009. Heard counsel for the petitioners and the State.
Petitioners are apprehending their arrest in connection with Samho (Begusarai) P.S.Case no.13 of 2008 instituted for alleged offences under Section 304(B), 201 and 34 of the Indian Penal Code.
Counsel for the petitioners submits that the deceased was suffering from mental ailment and she was treated for her mental disease. Inspite of that on account of her insanity she consumed excessive food. She was taken to P.M.C.H. but could not be saved. Other accused persons have been granted anticipatory bail in Cr.Misc.No.,41537 of 2008 by order dated 15.1.2009 and Cr.Misc.No.38343 of 2008 by order dated 6.1.2009.
Considering the aforesaid fact prayer for anticipatory bail is allowed. The petitioners namely Deo Niranjan Jha (Cr.Misc.No.46816 of 2008) and 1. Sharwan Jha alias Sharwan Kumar Jha alias Dukhharan Jha 2. Niraj Jha alias Manish Jha and 3. 2 Punkaj Jha of (Cr.Misc.No.46793 of 2008) are directed to surrender before the C.J.M.Begusarai within four weeks from today and on their so surrendering they shall be enlarged on bail on their furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of C.J.M.Begusarai in connection with Samho P.S.Case no.13 of 2008 subject to the condition as laid down under Section 438(2) Cr.P.C.
