The Advocate on record has abstained from Court work presumably because of the Resolution passed by the Madhya Pradesh High Court Bar Association on 24th April, 2015.
This act is in violation of the dictum of the Supreme Court as indicated in para 35 of the judgment rendered in the case of Ex-Capt. Harish Uppal v. Union of India and another (2003) 2 SCC 45.
Prima facie, the non-appearance of the Advocates appearing in this case constitutes professional misconduct. Therefore, issue show cause notice to the Advocate for having abstained from Court work pursuant to the decision of the Bar Association to show cause why appropriate action should not be taken against him including of imposing cost. Issue notice to the Advocate, viz., S/SHRI R.K. VERMA, ASHISH NEMA, S. VERMA, SHARAD VERMA, NITIN KARAN, ANSHUMAN SINGH, SATYENDRA PATEL, returnable on 17.6.2015.
List the matter after summer vacation. The show cause notice be listed along with this matter on 17.6.2015.
