The appellant has sought the following similar information from the Cantonment Boards mentioned in Annexure I:
I. In reference to Jr. Hindi Translator post
1. Whether DOP&T OM No. AB-14017/46/2011-Estt(RR) dated 19/09/2013 is applicable to all Cantonment Boards or not. If yes, whether action was taken according to it.
2. Provide a copy of the recruitment rules applicable for appointment to the post of Jr. Hindi Translator.
3. to 5. And other related information.
II. In reference to appointments being done in Cantonment Boards (CB) 2
6. Whether DOP&T OM No. AB-14017/48/2010-Estt(RR) dated 31/12/2010, DOP&T OM No. 35021/2/2009-Estt.(C) dated 03/07/2009 and DOP&T OM No. 13018/4/2009-Estt. (L) dated 08/07/2009 are applicable to all Cantt. Boards or not. If yes, whether action was taken according to it.
7. Whether all the recruitment rules have been made according to DOP&T OM No. AB-14017/48/2010-Estt(RR) dated 31/12/2010. If so, provide copies of the same.

Grounds for filing Second Appeal The CPIOs/FAAs did not provide satisfactory information.
Submissions made by Appellant and Respondent during Hearing:
The appellant's representative was heard on 30.06.2021 and 05.07.2021 by this bench and he had submitted that his contentions are the same for the present cases also.
The CPIOs were informed that the decision taken on 30.06.2021 and 05.07.2021 shall be applicable in the present appeals also.
Observations:
It is relevant to mention here that on 30.06.2021 the similar subject matter was adjudicated by this bench. The appellant's representative had at that time submitted that he has the same contentions in the above pending cases also. Therefore, the Commission having decided the issue already vide the previous orders, finds it appropriate to pass the same order for these cases also. The decision in case no. CIC/DODEF/A/2019/645622 passed on 30.06.2021 was as follows:
"The CPIOs of Cantonment Boards are cautioned to exercise due care in future to ensure that correct and complete information is furnished timely to the RTI applicant(s) as per the provisions of the RTI Act. In case information is required to be obtained from the custodian of the information, assistance should invariably be taken under Sec 5(4) of the RTI Act. Furthermore, the Commission is of the opinion that a suitable reply should be given to the appellant addressing points no. 1,6 and 10. Therefore, Shri Anil Kumar Paswan, Accountant and CPIO, Cantonment Board, Ramgarh is 3 nominated as Nodal CPIO for these cases, and is directed to take assistance u/s 5(4) from CPIO, Administration, DGDE and provide a suitable reply on points No. 1, 6 and 10 within 20 days from the date of receipt of the order explaining the status of the DoPT OMs and rules applicable to Cantonment Boards. Further, the CPIO (Administration), DGDE shall provide assistance as per the RTI Act. The appeals are disposed of accordingly."
Decision:
In view of the above observations, the same directions shall be followed by the CPIOs in today's second appeals. Sh. Dushyant Gurang, Storekeeper & CPIO, Lebong Cantonment, Darjeeling shall be treated as the Nodal CPIO for today's 11 second appeals, and he is accordingly directed to take assistance u/s 5(4) from CPIO, Administration, DGDE and any other CPIO listed above, and provide a suitable reply on points No. 1, 6 and 10 within 20 days from the date of receipt of the order explaining the status of the DoPT OMs and rules applicable to Cantonment Boards. Further, the CPIO (Administration), DGDE shall provide assistance as per the RTI Act.
The appeals are disposed of accordingly.
