1. Since an identical issue and common facts of law are involved in the bunch of these cases, they are heard analogously and are being disposed of by this common order.

The petitioners, who are working in various societies, have filed the instant writ petitions under Article 227 of the Constitution of India assailing the advertisement dated 4-9-2023 for appointment on the post of Samiti Prabandhak (Society Manager) on the count that as per Zila Sahkari Kendriya Bank Karmchari Sewa (Niyojan, Nibandhan Thaha Unki Karyasthithi) Niyam, 2023. Schedule D(2) as per Rule 4 of Sub Rule 2, 50% posts of Samiti Prabandhak will be filled up by direct recruitment having the requisite qualification of Graduate along with PGDCA and rest of the 50% posts will be filled up by the employees already working in the society by way of limited competitive examination.

Learned counsel appearing for respective petitioners would submit that the said Rules indicate that 50% posts have to be filled up from the departmental candidates through limited competitive examination,. but the advertisement is silent on this issue which has necessitated them to file the present writ petitions challenging the validity of the advertisement.

On the other hand, Mr. Prafull Bharat, learned Sr. Advocate assisted by Mr. Jitendra Shrivastava, and Mr. Sandeep Dubey counsel for the various Banks/respondents would submit that before issuance of advertisement, Registrar of Co-operative Societies issued various orders right from 4-5-2023, 12-5-2023 and 23-5-2023 regarding appointment on the post of Samiti Prabandhak in various banks and clarified that 50% posts will be filled up from the departmental candidates as per the rules. The operative part of the order dated 12-5-2023 reads as under:-

5. Since the grievance raised by the petitioners has already been redressed by the order dated 04-5-2023, 12.05.2023 & 23.05.2023 Neutral Citation 2024:CGHC:9218 31 issued by the Registrar, Co-operative Societies, at this juncture, nothing is required to be considered.

6. Accordingly, the bunch of these writ petitions are disposed of in view of the subsequent orders dated 04-5-2023, 12.05.2023 & 23.05.2023 passed by the Registrar, Co-operative Societies, Raipur which have been issued prior to issuance of the advertisement on 04.09.2023.

7. Pending interlocutory applications, if any, shall stand closed.
