ORDER:-
Questioning the notice in ROC No.TTD-81021(31)/6/2022 REV TML, dated 14-06-2022 issued by the 1st respondent in pursuance of its resolution No.14 and 56, dated 30-04-2022 permitting the transfer of licences in favour of the legal heirs/purchasers requesting them to furnish the documents in the format for renewal of licences, the petitioner filed the present writ petition.
It is contended by the learned counsel for the petitioner that his father was allotted quarter No.717 on a monthly rent. He was regularly paying the rents to the 1st respondent. During his lifetime, the father of the petitioner let out the said quarter in favour of the 2nd respondent for a rent. As he did not pay the monthly rents, the petitioner got issued a legal notice, dated 07-04-2022, to the 2nd respondent asking him to vacate the quarter, for which 2nd respondent issued a reply notice stating that he had purchased the quarter and later he sold the same to the 3rd respondent in the year 1996 itself.
The grievance of the petitioner is that the said quarter allotted in favour of his father cannot be alienated. But, it is pertinent to note that the petitioner is not questioning the resolution, dated 30-04-2022. He is only questioning the notice dated 14-06-2022. It seems that the dispute is purely civil in nature between the petitioner and respondent Nos.2 and 3. 2
In that view of the matter, this court deems it appropriate to dispose of the writ petition at the stage of admission directing the petitioner to make a representation to the 1st respondent ventilating his grievance and upon such representation being made, the 1st respondent shall consider his representation in accordance with law.
With the above observation, the writ petition is disposed of at the stage of admission. No order as to costs.
Miscellaneous Petitions pending, if any, shall stand closed in consequence.
