1. This is an application filed by the petitioners seeking a direction restraining the respondent from taking any coercive action against the petitioners for failing to file their annual return for the year 2020-2021 on account of their failure to provide details of the Foreign Contribution Regulation Act, 1976 (FCRA) account opened with the State Bank of India (SBI), Main Branch, Delhi.
2. Learned counsel for the petitioner submits that since this Court had already granted interim protection to the petitioner qua the return for the year 2019-20 and the last date for submission of return for the year 2020-21 is expiring on 31.12.2021, before which the writ petition Signature Not Verified DigitallySigned By:GARIMA MADAN Signing Date:21.12.2021 18:21:37 is likely to be decided, the respondent be restrained from taking any coercive action against the petitioner qua the year 2020-21.
3. Issue Notice. Mr.Shreesh Chadha accepts notice and does not propose to file any reply.
4. Keeping in view the petitioner's claim that it has not sought renewal of its registration under the FCRA, which stood expired on 26.05.2020, the petitioner would be required to file its return for the 2020-21 which it will presently not be in position to file as it does not have an account with the SBI, Main Branch, Delhi. It is, therefore, directed that till the next date, no coercive steps be taken against the petitioner for non- filing of the return for the financial year 2020-21 as well.
5. The application is disposed of with the aforesaid directions. W.P.(C) 11360/2021
