Mr. Niranjan Reddy, learned senior counsel states that insofar as the penalty as imposed by the National Company Law Tribunal and affirmed by the National Company Law Appellate Tribunal is concerned, appellant No.1 would deposit the entire penalty amount within a period of four weeks before the Tribunal.
Since the amount of penalty as imposed would be deposited by appellant No.1, we absolve the liability of appellant Nos. 2 to 4 for their appointment as independent directors.
The appeal is disposed of accordingly.
