***** Counsel for petitioners submits that the question which they have raised in the instant petitions came up for consideration before a Single Bench of this court in Adarsh Shikshak Prashikshan Mahavidayalaya Vs. National Council for Teachers Education & Ors. (CWP-8236/2012) decided on 26.9.2012 and it has been observed that the application submitted by the Institution has to be considered by the respondent independently without taking recourse to the policy of the State Government dt. 17.11.2008 & 03.01.2009 respectively. The operative part whereof being relevant for the present purpose reads ad infra:
Consequently, the writ petition is allowed. The decision taken by the respondent in the impugned minutes of 193rd Meeting of NCTE held on 8-10.2.2012, qua the petitioner Institution (Item No. 193.20.3) is hereby quashed and set aside. The matter is remitted back to the respondents to consider and decide the application of the petitioner Institution filed on 13.12.2007 for starting B.Ed. Course in accordance with the regulations of 2007 without reference to the State Government policy decision dated 17.11.2008 and 3.1.2009. The entire exercise be concluded within a period of one month, from the date of certified copy of this order. There shall be no order as to costs.
Counsel for respondents is unable to controvert regarding the controversy being decided by the Coordinate Bench, as indicated above.
In the light of the order of Coordinate Bench dt.26.9.2012, this Court considered appropriate to direct the respondents to decide the application of the petitioner-Institution for starting B.Ed./STC Course in accordance with the Regulations, 2007 without reference to the State Government policy decision dt. 17.11.2008 and 03.01.2009 and the exercise be completed within a period of one month from the date of certified copy of this order being furnished.
Accordingly, all the writ petitions stand disposed of.
