                                                            ORDER

This Civil Revision Petition has been filed against the fair and decreetal order dated 17.11.2021, made in I.A.No.6 of 2021 in O.S.No.108 of 2019, on the file of the Principal District Munsif Court, Manamadurai.

2.The petitioner is the defendant in O.S.No.108 of 2019 before the Principal District Munsif Court, Manamadurai. The above suit has been filed by the https://www.mhc.tn.gov.in/judis 1/5 C.R.P.(MD)No.2076 of 2021 respondent for mandatory injunction and for a declaratory relief. In the suit, the respondent has filed I.A.No.6 of 2021 for introducing additional evidence, namely, an unregistered partition deed, which is said to have been executed on 16.07.1995. By the impugned order, the Court below has allowed the application subject to the respondent paying the requisite stamp duty payable under Section 35 of the Indian Stamp Act, 1899. 3.The learned counsel for the petitioner submits that the prayer in I.A.No.6 of 2021 was for marking an unregistered partition deed, whereas, the Court has allowed marking of a sale deed, dated 16.07.1995. It is therefore submitted that the impugned order is liable to be set aside.

4.A perusal of the fair and decreetal order dated 17.11.2021, passed in I.A.No. 6 of 2021 in O.S.No.196 of 2019 indicates that the said I.A. has been allowed. The Court below has not stated that the I.A. has been disposed of by allowing the respondent to mark the sale deed, dated 16.07.1995. No doubt, in Paragraph 12 of the impugned order, which has been extracted above, the learned Principal District Munsif, Manamadurai, has referred to a sale deed, dated 16.07.1995.

5.It is evident from a reading of the petition filed in support of I.A.No.6 of 2021 and the counter of the petitioner, a reference is made only to a partition deed and not to a sale deed. Thus, it is clear that the reference to the sale deed in the impugned order is a typographical error.

6.Be that as it may, there is no scope for interfering with the impugned order. https://www.mhc.tn.gov.in/judis 3/5 C.R.P.(MD)No.2076 of 2021 It is open for the petitioner to obtain suitable clarification from the Court below or in the alternative, to raise objection regarding marking of document in variance with the affidavit and the petition filed in support of I.A.No.6 of 2021.

7.Considering the fact that the suit is of the year 2019, the Trial Court is directed to dispose of the suit as expeditiously as possible, preferably, within a period of nine months from the date of receipt of a copy of this order.

8.This Civil Revision Petitions stands disposed of with the above observation and direction. No costs. Consequently, connected Miscellaneous Petition is closed.
