Hon'ble Shri Justice P. Sam Koshy
                                 Order On Board
27.10.2021

1. The limited grievance that the petitioner has in the present writ petition is the inaction on the part of the respondents in not providing the family pension to the petitioner, i.e. the mother of the deceased.

2. According to the petitioner, her son Late Shri Ignatius Lakra working on the post of Constable in 10th Battalion of Chhattisgarh Armed Force, died on 11.12.2002. On the death of the son, the family pension was being paid to the husband of the petitioner i.e. the father of the deceased and the pension was paid till 23.08.2020 when the husband of the petitioner expired. 2

Thereafter the petitioner in the capacity of mother of the deceased was entitled for the family pension but it has not been further extended.

3. Given the limited grievance that the petitioner has this Court of the opinion that it is not a case which could be admitted and reply be filed, rather ends of justice would meet if the writ petition is disposed at the admission stage directing the respondents 1, 2 & 3 to ensure that entitlement of the family pension of the petitioner against the death of the son of the petitioner which was being paid to the husband of the petitioner as long as he was alive in the capacity of the father till 23.08.2020, be scrutinized and decided at the earliest preferably within a period of 60 days from the date of receipt of copy of this order.

4. The writ petition accordingly stands disposed of.
