                       WRIT PETITION No.9214 of 2025

ORDER:

This Writ Petition is filed by the petitioner seeking the following relief:

"...to issue a Writ or order or direction, more particularly a Writ of Mandamusdeclaring the action of the Respondent No 2 not including the Petitioners name in provisional selection list as Hostel Welfare Officer Grade-I in spite of that the Petitioner secured 517 State Rank and 22 Rank in the 5th Zone in Women Quota and BCE priority out of 18 general posts and 1 BCE Women Quota altogether 19 posts whereas 5 merit candidates not qualified in certificates verification process and 2 candidates obtained different zones as such Petitioners rank will be 14 in spite of that Respondent No 2 not included the Petitioners name in provisional selection list as illegal arbitrary and violation of principles of natural justice consequently direct the Respondent No 2 to include the Petitioners name in provisional selection list as Hostel Welfare Officer Grade-I in Tribal welfare Department Schedule caste Development BC welfare Department Warden GRI GRII Matron Grade-I and II Post in Director of Disabled and Senior Citizen Welfare and lady Superintendent Children Home in Women Development and Child Welfare Department and issue recruitment Order and pass such other order etc..."

2. Heard Mr. M.A.K.Mukheed, learned counsel appearing for the petitioner, learned Government Pleader for Education appearing for respondent No.1 and Mr. P.S.Raja Sekhar, learned Standing Counsel for TGPSC appearing for respondent No.2. Perused the material available on record.

Learned counsel for the petitioner submits that the present writ petition has been filed by the petitioner, challenging the action of respondent No.2, who, despite the petitioner's merit and eligibility, failed to include her name in the provisional selected list for the posts of Hostel Welfare Officer Grade-I in Tribal Welfare Department, 2 Schedule Caste Development, BC Welfare Department, Warden Grade-I & II, Matron Grade-I & II, Post in Director of Disabled and Senior Citizen Welfare and Lady Superintendent Children Home in Women Development and Child Welfare Department, pursuant to Notification No.25/2022, dated 23.12.2022.

4. Learned counsel for the petitioner further submits that the petitioner has completed M.Sc in Chemistry, M.Ed. and has teaching experience. The petitioner belongs to the BC-E category. It is further contended that respondent No.2 issued a notification vide No.25/2022, dated 23.12.2022 for the recruitment of various posts, including Hostel Welfare Officer Grade-I in Tribal Welfare Department, Schedule Caste Development, BC Welfare Department, Warden Grade-I & II, Matron Grade-I & II, Post in Director of Disabled and Senior Citizen Welfare and Lady Superintendent Children Home in Women Development and Child Welfare Department. As per the notification, total 581 posts are available (excluding those for the disabled category), and 561 posts were allotted to General, BC, and SC categories, under which the petitioner is eligible. The petitioner participated in the examination held by the 2ndrespondent and secured 187.73706 marks out of 300, obtaining a state rank of 517.

5. Learned counsel for the petitioner further submits that out of 561 posts some posts are remained vacant because certain candidates opted for other positions. The petitioner belongs to the 5th zone under BC-E category, where 18 posts were allotted. Respondent No.2 issued provisional appointment letters to 16 candidates, out of which 2 individuals were selected from other zones (6th and 7th zones). There were also 5 members disqualified during certificate verification, and 2 others were absent, total 7 candidates were not in the final merit list. It is further submitted that the petitioner's name was excluded from the provisional selection list despite the aforementioned vacancies. She asserts that her rank should now place her at position 15 on the merit list, and she is eligible for selection in both the Women's and BC-E quotas.

6. Learned counsel for the petitioner further submits that the petitioner made a representation on 18.03.2025 to respondent No.2 with a request to allot her to the said post. However, no action was taken by respondent No.2. Therefore, the petitioner filed the present writ petition.

7. Learned counsel for the petitioner further submits that appropriate orders be passed in this writ petition by directing the respondent authorities to consider the above representation 4 submitted by the petitioner and pass appropriate orders in accordance with law.

8. On the other hand, learned Standing Counsel for TGPSC, appearing for respondent No.2 submits that the respondent authorities would consider the representation submitted by the petitioner and pass appropriate orders thereon, in accordance with law

Having considered the submissions made by learned counsel for the petitioner and without going into merits of the case, respondent No.2 is directed to consider the representation of the petitioner, dated 18.03.2025 and pass appropriate orders in accordance with law, within a period of three (03) weeks from the date of receipt of a copy of this order.

10. With the above direction, the Writ Petition is disposed of in the admission stage itself. No order as to costs.

As a sequel, miscellaneous applications pending, if any, in this Writ Petition, shall stand closed.
