The learned counsel for the petitioner is seeking two weeks' time for filing rejoinder-affidavit.

Mr. Prashant Kumar Singh, the learned counsel for the respondent-RMC states that besides non-adherence to the conditions of agreement dated 14.08.2008, the petitioner has defaulted in making payment of the amount under the agreement.

It is hereby ordered that all pending dues (about Rs. 29 lacs) as claimed by the respondent-RMC shall be paid by the petitioner on or before 01.06.2017 and it shall produce documentary evidence of such payment on the next date of hearing, however, the payment made shall be subject to final calculation and adjustment.

Since the agreement was executed with the petitioner for construction/maintenance of passenger-shelters meant for the passengers travelling through the buses deployed by the respondent-RMC, a query was put by the Court to the learned counsel for the respondent-RMC on the status and number of buses deployed on roads at Ranchi. After the recess, on instructions, the learned counsel states that at present 51 buses are on road and 14 are under repair. He further states that 26 new buses have already been purchased which would be on road within 3-4 weeks.

However, it is stated that condition of most of the old buses is dilapidated which needs either refurbishment or replacement. The learned counsel for RMC shall seek instruction on this aspect and file affidavit regarding requirement of new buses.

Post the matter on 13.06.2017.

Meanwhile, interim order dated 12.04.2017 shall continue.
