G.S.R., 817,(E) dated 23rd December, 1999. - In exercise of the powers conferred by Cl. (b) of sub-section (2) of Section 156 of the Indo-Tibetan Border Police Force Act, 1992 (35 of 1992) and in supersession of (i) the Indo-Tibetan Border Police Commandant (Engineer) and Assistant Commandant (Engineer) Recruitment Rules, 1982 and (ii) the Indo-Tibetan Border Police Company Commander (Engineer) Recruitment Rules, 1984, and the Indo-Tibetan Border Police Additional Deputy Inspector General (Engineer) Recruitment Rules, 1990 except as respects things done or omitted to be done before such supersession, the Central Government hereby makes the following rules regulating the method of recruitment to Group 'A' posts in Engineering Cadre in the Indo-Tibetan Border Police Force, namely :

1. Short title and commencement.

(1)These rules may be called the Indo-Tibetan Border Police Force, Engineering Cadre (Group 'A' Posts) Recruitment Rules, 1999.
(2)They shall come into force on the date of their publication in the Official Gazette.

2. Number of posts, classification and scale of pay.

- The number of the said posts, their classification and the scales of pay attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.

3. Method of recruitment, age limit and other qualifications.

- The method of recruitment to the said posts, age-limit, qualifications and other matters relating thereto shall be as specified in columns (5) to (14) of the said Schedule.

4. Disqualification.

- No person-
(a)who has entered into or contracted a marriage with a person having a spouse living; or
(b)who, having a spouse living, has entered into or contracted a marriage with any person, shall be eligible for appointment to any of the said posts:
Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

5. Power to relax.

- Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order and for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any or category of persons.

6. Saving.

- Nothing in these rules shall affect reservations, relaxation of age-limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, other Backward Classes, Ex-servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

No. 634(E), dated 3.9.2001 (w.e.f. 23.12.1999)]regular service in the grade and total of twenty yearsgroup 'A' service in theIndo-Tibetan Border Police Force and having degree in CivilEngineering from a recognised Institution, subject to being inmedical category SHAPE-I.Bydeputation:Fromamongst officers holding analogous posts or eligible to holdanalogous post in Military Engineering Service or Central/StatePublic Works Department or General Reserve Engineering Force orofficers holding analogous post or eligible to hold analogouspost in Central Para Military Organisation having Degree in CivilEngineering. (The period of deputation including the period ofdeputation in another ex-cadre post held immediately precedingthis appointment in same or some other organisation or departmentof the Central Government shall ordinarily not exceed threeyears).The maximum age limit forappointment by deputation shall be not exceeding 56 years as onthe closing date of receipt of applications.Byre-employment:-Fromamongst officers :-(i)who have held the rank ofBrigadier or equivalent in the Corps of Engineers in the ArmyIAir Force /Navy, or(li)who have held the rank ofColonel or equivalent in th.eCorps of Engineers in the Army/Air Force/Navy with minimum twoyears regular service in the grade.
