Order 01/02/2022 In wake of onslaught of COVID-19, as per guidelines, lawyers have been advised to refrain from coming to the Courts, therefore, hearing of the matter is being taken up only through video conferencing.

Heard learned counsel for the appellant appearing through video conferencing as well as learned Public Prosecutor, present- in-person. Perused the material available on record.

Learned counsel for the appellant stated that the present appeal (No.53/2022) has wrongly been tagged with the Appeals No. 54/2022 (Mahesh Chandra Vs. State of Rajasthan) and No. 55/2022 (Mukesh Kumar Vs. State of Rajasthan), therefore, the present appeal may be detached from the appeals, as mentioned above.

It is noticed that the Appeals No. 54/2022 (Mahesh Chandra Vs. State of Rajasthan) and No. 55/2022 (Mukesh Kumar Vs. State of Rajasthan) have been filed in connection with FIR No. 2/2022, Police Station Rohida, District Sirohi for the offences (Downloaded on 01/02/2022 at 08:39:07 PM) (2 of 2) [CRLAS-53/2022] punishable under Sections 341, 323, 427, 285, 286, 336, 307/34 of the Indian Penal Code as well as Section 3(2)(va) of the SC/ST (Prevention of Atrocities) Act and Section 3/7 of the Essential Commodities Act; whereas, the present appeal (No. 53/2022) has been filed in connection with FIR No. 35/2021, Police Station Jhab, District Jalore for the offences punishable under Sections 363, 342, 376 DA of the Indian Penal Code as well as Section 3/4(2), 5(g)/6 of the Protection of Children from Sexual Offences Act, 2012 and Sections 3(1)(W)(i) and 3(2)(v) of the SC/ST (Prevention of Atrocities) Act, 1989.

In view of the above circumstances, Office is directed to detach the appeal (No.53/2022) from the Appeals No. 54/2022 (Mahesh Chandra Vs. State of Rajasthan) and No. 55/2022 (Mukesh Kumar Vs. State of Rajasthan) and list the matter (Appeal No. 53/2022) separately.

Learned counsel Mr. shah appearing for the appellant stated that the matter is required to be heard in the physical mode of the hearing, therefore, the same may be adjourned.

As requested by the learned counsel for the appellant (Bharmal Ram), list the matter next week.
