Briefly, the facts of the case is that the applicant was appointed on 08.07.1993 on daily wages and thereafter, he was given regular appointment as Plant Attendant on 22.03.1995 in the pay scale of 1350- 1630 (L-1 Grade). The applicant was promoted as Coil Binder cum Processing Hand (S-4 Grade) by order dated 27/29.12.2006. The applicant was also promoted from S/6 grade to S/7 grade by order dated 29.12.2017.
In the year 2003 a false and frivolous complaint was made against the applicant and 17 other persons by alleging them to have obtained illegal appointment on the bases of forged caste certificate. A District level scrutiny committee conducted enquiries and thereafter on 6.2.2013 matter was referred to the High Power Caste Scrutiny Committee. The High Power Caste Scrutiny/Verification Committee initiated enquiry in the matter. Firstly a report was prepared by the Vigilance Cell in that certain observations were made against the applicant's social status on the basis of documentary evidence. On the basis of all proof so collected the Vigilance Cell arrived to a very weird conclusion by notifying a new class of caste namely Baya Mahara Neither it was Baya' nor 'Mahara', surprisingly none RAJU Digitally signed by RAJUL NAMDEO L of the documents so examined have entry like 'Baya Mahara. Date: 2026.02.02 14:17:45+05'30' Foxit PDF Reader Version: 2024.3.0 EO complete investigation the Investigation Assistant submitted his report to Page 2 of 9 3 O.A.No. 203/00296/2020 the High Power Caste Scrutiny/Verification Committee and in his report the authority finds that applicant has identical status in the society as other members of Mahar' community persons have. Copy of report dated 28.02.2019 is annexed as Annexure A/2. The respondents have issued order dated 25.01.2020 whereby the caste certificate issued to the applicant has been cancelled and concern authorities have been directed to take appropriate steps in accordance with the provisions contained in Section 9 (3) of The Chhattisgarh Schedule Castes, Schedule Tribes and Other Backward Classes (Regulation of Social Status Certification) Rule, 2013. The impugned order dated 25.1.2020 was challenged by the applicant in W.P. (C) No. 842/2020 before the Hon'ble High Court of Chhattisgarh and on 5.3.2020 the Hon'ble High Court stayed the effect and operation of the impugned order dated 25.1.2020. Copy of order dated 5.3.2020 is annexed as Annexure A/4. On the date of preliminary hearing of aforesaid writ petition the counsel for the Respondent Bhilai Steel Plant informed the High Court that they have already acted upon the decision taken by the High Power Caste Scrutiny Committee and have cancelled the appointment of the applicant granted on 22.3.1995 and accordingly the applicant will not be paid the benefits of CPF, Gratuity, Pension, SESBF and leave encashment etc. RAJU Digitally signed by RAJUL NAMDEO L 3. Date: 2026.02.02 14:17:45+05'30' Foxit PDF Reader Version: 2024.3.0 EO applicant was given regular appointment as Plant Attendant on 31.12.1994 Page 3 of 9 4 O.A.No. 203/00296/2020 in L-1 grade against a vacancy reserved for Scheduled Caste candidate based on Caste certificate produced at the time of appointment, according to which he was shown as Mahar Caste, a SC community caste.
Thereafter, he was promoted as Coil Binder cum Processing Hand on 31.12.2005. He was again promoted from S-4 to S-5 grade on 31.12.2009, S-5 to S-6 grade on 31.12.2013 and from S-6 to S-7 grade on 31.12.2017 as Coil Binder cum Processing Hand. A complaint was received in the Office of Respondents that applicant and 17 others fraudulently secured appointment under the respondents on the basis of forged caste certificate.
Basing the above complaint, the matter was referred to Caste Scrutiny Committee constituted at the District level to ascertain the actual caste of the applicant and others and the Caste certificate produced by them are proper or not. The said committee conducted the enquiry at their level and referred the matter on 06.02.2013 to High Level Caste Scrutiny committee. The State Level Committee after conducting thorough enquiry and taking into account of all evidences and submissions of the applicant passed an order on 25.01.2020 whereby the committee held that he does not belong to Mahar Caste, a SC community caste, and the Caste certificate produced by him was not legally and properly issued, hence it was cancelled.

5. In the instant case, the applicant has filed one Misc. Application No. 200/1050/2025 in which it is stated that the applicant has challenged the order dated 04.03.2020, whereby his appointment granted on 22.03.1995 was cancelled with a further direction that he will not be paid the benefits of CPF, Gratuity, Pension, SESBF and leave encashment etc. as the appointment of the applicant has been cancelled on the basis of the order of the High Level Caste Scrutiny committee dated 25.01.2020. The order of the High Level Caste Scrutiny/verification Committee dated 25.01.2020 Annexure A/3 was challenged by the applicant by filing writ petition before the Hon'ble High Court Chhattisgarh, Bilaspur which was registered as WPC No. 842 of 2020. The said WPC was finally decided by the Hon'ble High Court Chhattisgarh on 06.03.2024, whereby the order of the High Level Caste Scrutiny/verification Committee dated 25.01.2020 Annexure A/3 was set aside and the matter was remitted back to respondent No. 3 to consider and decide it, afresh in accordance with law after affording due opportunity of hearing to the applicant taking into consideration the affinity test report submitted by the research assistant, other reports and the provisions contained under Rule 20 of the Chhattisgarh scheduled castes, scheduled tribes and other backward classes(regulation of social status certificate) Rules 2013. Date: 2026.02.02 14:17:45+05'30' Foxit PDF Reader Version: 2024.3.0 EO Certificate Scrutiny Committee, Directorate of Tribal Research and Page 5 of 9 6 O.A.No. 203/00296/2020 Training Institute, Chhattisgarh has passed an order dated 07.05.2025 (Annexure A/10), wherein it has been held that the certificate of "Mahar Schedule Tribe issued by the Deputy Collector, District-Durg dated 18.09.1984 in favour of the Shri Santosh Bhaskar S/o Johan Ram is valid and it is accepted. The operative portion of the order of Hon'ble High Court of Chhattisgarh in W.P.C. No. 842/2020 is reads as under:-
"..........11. Taking Into consideration the facts discussed above and the law laid down by the Apex Court in the case of Mah. Adiwasi Thakur Jamat Swarkshan Samiti (supra), in the opinion of this Court, respondent No. 3/High Power Certification Scrutiny Committee has committed an error of law in not considering the affinity test and the report submitted by the Research Assistant dated 28.01.2019, therefore, the order passed by the High Power Caste Scrutiny Committee dated 25.01.2020 deserves to be and is hereby set aside. The matter is remitted back to respondent No. 3 to consider and decide it afresh in accordance with law after affording due opportunity of hearing to the petitioner and taking into consideration the affinity test report submitted by the Research Assistant, other reports and the provisions contained under Rule 20 of the Chhattisgarh Scheduled Castes, Scheduled Tribes and Other Backward Classes (Regulation of Social Status Certification) Rules, 2013.
12. Accordingly, the writ petition is allowed to the extent indicated hereinabove."

3. सिमित के अ शासकीय प िदनां क 11.12.2015 के ारा करण िजला रीय छानबीन सिमित, िजला बालोद से जांच कराये जाने तथा अनावेदक को सुनवाई का समुिचत अवसर दान करने संबंधी िनदश के साथ ेिषत िकया गया।

िविजलस से ल से िदनाँक 17/02/2025 को ाप् त अ ेषण ितवेदन के अनुसार धारक ारा ुत जाित माण-प वैधता परी ण प म अपने दादा ी सदाराम भा र का मूल िनवास एवं अपने िपता को ज से ाम-दरीटोला, पो -बरही, तहसील बालोद, िजला-दु ग, वतमान िनवास ाम-बडगां व, तहसील-डौडीलोहारा, िजला-बालोद, यं को ज से छ ीसगढ़ का िनवासी होना िलखा है। साथ ही अपना कुलदे वी/ दे वता दु ादे व, गोसाई, पुसाई ले ख िकया है। माननीय उ तम ायालय के िनणय ए.आई.आर 1995 सु ीम कोट 1506 (डायरे र टायबल वे लफेयर आ दे श बनाम लावेती िगरी एवं अ ) म िनधा रत िकया गया है िक अपनी जाित एवं सामािजक ा थित को सािबत करने हेतु सबूत का भार उस का है , जो सं वैधािनक लाभ ा िकया हो। उ के तारत म धारक ने रा पित अिधसूचना िदनाँ क 10/08/1950 (अनु सूिचत जाित वग के िलए) के पूव के रकाड म अपने िपता जोहन व सदाराम का ज -मृ ु पंजीयन रिज र वष 1943 ु त िकया िजसम उनकी जाित "महार" उ े खत है।

सं तोष कुमार भारकर िपता जोहनराम भा र के ारा ुत ज -मृ ु पंजीयन रिज र वष 1943 म उनके िपता की अं िकत जाित महार एवं ी संतोष कुमार भा र के दादा सदाराम व उनके भाई अजबिसं ह, सदलिसं ह िपता रामगुलाब दर टोला का राज अिभलेख वष 1930-31 म जाित महरा अंिकत है। भारत के राजप म 14 अग 2023 को कािशत संिवधान (अनुसूिचत जाित) आदे श (संशोधन) अिधिनयम, 2023 म छ ीसगढ़ रा की अनु सूिचत जाित की सूची के स. क. 33 पर Mahar, Mahara, Mahra, Mehar, Mehra ित थािपत होने के कारण महार, महरा दोनों ही जाित नाम वतमान म छ ीसगढ़ रा की अनु सूिचत जाित की सूची म शािमल है। अतएव सिमित ारा करण के संपूण प रशीलन के आधार वतमान संवैधािनक व था अनु प ी सं तोष भा र िपता ी जोहन राम के प म िड ी कले र दु ग िजला-दु ग ारा िदनाँ क 18/09/1984 को जारी "महार' अनुसूिचत जाित के सामािजक ा थित माण-प को मा िकया जाता है ।
उ रीय माणीकरण छानबीन सिमित ारा पा रत इस आदे श की ित सवसंबंिधत को पंजीकृत डाक के मा म से सू चनाथ ेिषत की जाव।
6. In view of the orders passed by the High Power Certificate Scrutiny Committee as well as the orders passed by the Hon'ble High Court of Chhattisgarh, the Original Application is allowed. The order dated 04.03.2020 is quashed and set aside. The respondents are directed to reinstate the applicant in service with all consequential benefits. The said exercise be completed within a period of 60 days from the date of receipt of a certified copy of this order.
