Order No. 13.01.2025 04. 1. This matter is taken up through hybrid mode.
2. The Office Note indicates that A.D. has not been received from Opposite Party No.2, namely, Maa Mangala Temple Trust represented through the Executive Officer, Kakatpur in the district of Puri, but the Postal tracking report indicates that notice has already been delivered in the address.
3. None appears for Opposite Party No.2 when the matter is called.
4. Mr. Bahali, learned counsel appearing for Opposite Party No.3 submits that in the meantime, the petitioner has Page 1 of 2 // 2 // taken back the bid amount deposited by the petitioner pursuant to the tender process, which has already been set aside in the meantime, which is seriously disputed by Mr. Acharya, learned counsel for the petitioner.
5. Mr. Nath, learned counsel for the Commissioner of Endowments submits that he has no instruction on the same.
6. Let the instruction in that regard be obtained.
7. It is also stated by Mr. Bahali, learned counsel for Opposite Party No.3 that the last date of filing of the application in the fresh tender is 15th January, 2025.
8. Had the Executive Officer of Maa Mangala Temple Trust appeared, the matter could have been appreciated better. Hence, we direct the Executive Officer of Maa Mangala Temple Trust, Opposite Party No.2 to either appear before this Court in person or through his learned counsel along with the records on the next date to assist the Court for proper adjudication of the case.
4. Put up this matter on 10th February, 2025.
5. Registry shall communicate this order to Opposite Party No.2 forthwith.
