The present writ petition has been filed by the petitioners claiming the benefit of technical pay-scale of Rs.1200-2040 w.e.f. 1.5.1990 and for the grant of further revised technical pay-scales.

Counsel contends that the claim raised in the present writ petition would be covered in terms of judgment dated 18.1.2010 passed by this Court in C.W.P. No.18754 of 1991 in case titled as Gurdev Singh and others v. State of Haryana and others (Annexure P.3). Counsel further submits that even a legal notice dated 12.10.2012 (Annexure P.4) already stands served upon the respondent- authorities.

In the light of the facts noticed hereinabove, I deem it appropriate to dispose of the instant writ petition with a direction to respondent No.1 to consider the claim of the petitioners and take a final decision on the legal notice dated 12.10.2012 (Annexure P.4) strictly in accordance with law and by passing a speaking order within a period of four months from the date of receipt of a certified copy of this order. C.W.P. No.731 of 2013 -2-

It is, however, clarified that in the eventuality of the petitioner's claim being found covered under the decision of this Court in Gurdev Singh's case (supra), it shall be open for the respondent- authorities to limit the benefit of actual arrears to a period of 38 months prior to the date of filing of this petition.
