In view of the order sought and proposed to be made, no previous service is required to be effected on the opposite party. The petitioner will, however, be obliged to forward copies of the petition and this order to the opposite party without undue delay.
The petitioner is the plaintiff in a suit for eviction instituted in 1984. The petitioner has relied on an extract from the order sheet, which reveals that the suit has been adjourned on several occasions in recent times for no apparent fault on the part of the petitioner.
CO 2528 of 2017 is disposed of by requesting the Civil Judge(Junior Division), Additional Court at Chandannagore to take up the suit now renumbered as Title Suit No. 1577 of 2014 as expeditiously as possible and dispose of the same, preferably, in course of this calendar year.
The trial Court is also reminded that a policy decision has been taken by this Court for ensuring that all matters which are ten years or older and pending before a court should be disposed of, without compromising with the quality of the judgement, by March 31, 2018.
The petitioner will forward a copy of this order to the District Judge for the District Judge to monitor the progress of a matter pending for more than 22 years. 2 There will be no order as to costs.
