Challenge has been made to the order dated 12.01.2022 passed in RCSA/42-A/2015 [Kuddo Bai (dead) and another Vs. Ayyanjan Singh and others] by which the application of the applicant under Order 7, Rule 11 of C.P.C. was dismissed and the case has been fixed for plaintiff's evidence.
It is observed that by order dated 7.3.2022 the proceedings before the concerned Court was stayed only for a period of three months. That period has expried in the month of July, 2022 itself.
At this juncture, learned counsel for the appellant seeks time to argue the matter on admission as his senior is out of station, therefore, time is granted but it is made clear that in this case, there is no stay. Accordingly, information be sent to the concerned Court expeditiously.
As prayed by the counsel for the applicant, list the case after one week. Let copy of this order be sent to the concerned Court for information and necessary action.
