No. 1457 of 2020 In Re.: An application for anticipatory bail under Section 438 of the Code of Criminal Procedure filed on 07.02.2020 in connection with Harishchandrapur Police Station Case No. 673 of 2019 dated 19.09.2019 under Sections 143/342/186/332/353/323/324/307/427/34 of the Indian Penal Code read with Section 3 of PDPP Act.

Mr. Krishan Ray Ms. Amrita Chel Mr. S. Das ...for the petitioner Mr. Rudradipta Nandy .... for the State It is submitted by the learned Counsel appearing for the petitioner that co-accused persons have been granted pre-arrest bail.
Learned Counsel appearing for the State produces the case diary. In view of extent of complicity of the petitioner and as the co- accused persons have been granted pre-arrest bail, we are inclined to extend the same privilege to the petitioner.
Accordingly, we direct that in the event of arrest the petitioner shall be released on bail upon furnishing a bond of Rs.10,000/-, with two sureties of like amount each, to the satisfaction of the arresting officer and also be subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973 and on condition that the petitioner shall appear before the investigating officer and hand over 2 his passport, if any, within a fortnight from date. In the event he does not have passport, he shall personally appear before the investigating officer and furnish affidavit to that effect within the time frame mentioned hereinabove.
