                                         ORAL ORDER

1. This is a third successive bail application. The applicants herein are charged with the offence of murder. In all fourteen persons have been chargesheeted.

2. I am told that seven have been released on bail so far. The others are still in custody. The last bail application filed by the applicant herein was rejected as not pressed on 16th October, 2015. At that time this Court had clarified that if the trial is not completed within a period of eight months then it shall be open for the applicant to pray for bail.

3. I am told that the trial has already commenced and four witnesses have been examined so far, however, the last witness was examined in the month of January, Page 1 of 2 HC-NIC Page 1 of 2 Created On Sun Jun 19 03:47:00 IST 2016 R/CR.MA/14046/2016 ORDER 2015. Past six months no other witnesses have been examined.

4. The Sessions Court, Modasa, is directed to see that the Sessions Case No. 35 of 2014 is proceeded on day to day basis and is completed within a period of three months from today. If there is any lapse on the part of the concerned Court in complying with this direction, the officer will be answerable. Disposed of.
