Information sought:
The Appellant filed an RTI application dated 03.11.2023 (offline) seeking the following information:Page 1 of 6
"1. कोई ै कमैन कमचार िजसका Medical category A2 & Below है और उसको PME 10 वष के बाद भेजा जाता है और उसके च क सा जांच के दौरान Colour vision पाया जाता है तो (A) "या उसे #बना Medical fit कये #बना उसे ै क पर काय करने के $लए वापस भेजा जा सकता है ! (B) उस कमचार को PME के दौरान 'वभाग के )नद* शानस ु ार 30 -दन. का समय लगता है एवम ् उपि0थ)त पंजी म3 30 -दन. तक PME लगा है तो इस 5म म3 वेतन भुगतान के अंतगत कमचार के अवकाश खाता से कटौती कया जायेगा या 9शास)नक अवकाश 9दान कया जायेगा ! (C) अगर उस कमचार का PME जांच के दौरान Color vision पाया जाता है तो सरु :ा एवम ् संर:ा के ;ि<ट कोण से च क सक के >वारा ै क मैन B1 category म3 आता है ऐसा $लख कर वापस भेज -दया जाता है "या ! (D) य-द कसी ै कमैन को पहला Medical जांच के दौरान Medical category A2 & Below -दया गया उसके 10 वष का सेवा दे ने के बाद पुनः मेBडकल जांच के $लए भेजा गया और उसे Colour vision पाया गया तो उसे कस Medical category म3 रखा जायेगा! उपरो"त #बंदओ ु को Eयान म3 रखते हुए 'व0तार पूवक जवाब दे ने का कृपा कर3 "
The CPIO furnished a point-wise reply to the Appellant on 11.11.2023 stating as under:
"मद सं० 01 (ए): इस संबंध म3, आई.आर.आर.एम.-2000 के अंतगत ेकमेन हेतु )नधाJरत मेBडकल केटेगर म3 कमचार के फटनेस कL ि0थ)त पर उसकL उ"त पद पर काय करना )नभर करता है ।
मद सं० 01 (बी): पी०एम०ई० (आव धक च क सीय जॉच) म3 आयेकमचार का 9शास)नक कारण (जो औसतन 01 से02 -दन और अ धकतम 05 -दन तक का 'वलOब हो सकता है ) के अ)तJर"त हुए 'वलOब को )नयमानस ु ार कमचार के Pयि"तगत अवकाश सेकटौती कL जाती है ।Page 2 of 6

मद सं० 01 (डी): इस संबंध म3, उपरो"त मद सं०: 01 (ए) एवं 01 (सी) म3 वQणत मद के अनस ु ार, आई. आर.आर.एम.- 2000 के उ चत पारा के अंतगत )नधाJरत )नयम के अनस ु ार स:म अ धकार >वाराआवRयक कायवाह कयाजाताहै ।"
Being dissatisfied, the appellant filed a First Appeal dated 14.11.2023. The FAA vide its order dated 16.11.2023, held as under:
"सच ू ना अ धकार अ ध)नयम 2005 के अSतगत आपका अपील आवेदन -दनांक 14.11.2023 सद$भत पंजीकरण के माEयम से इस कायालय म3 9ाTत हुआ है । इस संबंध म3 मुUय च क सा अधी:क, पव ू मEय रे ल, धनबाद का पVांक एच०/ आरट आई०/'व'वध/अपील / बी० के०बी०/660 -दनांक 15.11.2023 के तहत सूचना उपलWध करायी गयी है , िजसकL छाया9)त इस पV के साथ संलYन कर आपके सूचनाथ भेजी जा रह है ।"
The CPIO furnished a reply to the Appellant on 15.11.2023 stating as under:
"उपरो"त संद$भत 'वषय के आलोक म3 आवेदक के मल ू आवेदन, -दनांकः 03.11.2023 (संदभ सं० 1 (i) के मद सं० 01 (ए) से 01 (डी) तक पर वां\:त ू ना पर, च क सा 'वभाग, रे ल मंडल, धनबाद का अ]यिु "त (इस कायालय का सच संदभ पVांकः एच/आर.ट .आई./'व'वध/बी०के०बी०/659, धनबाद, -दनांकः 11.11.2023) के अंतगत द गई थी, वह यथावत है ।
उपरो"त आपके सच ू नाथ एवं आवRयक कायवाह के )न$मत 9े'षत कया जा रहा है ।"
Feeling aggrieved and dissatisfied, appellant approached the Commission with the instant Second Appeal.
A written submission dated Nil filed by the appellant prior to the hearing is taken on record. Contents of the same are reproduced below for ready reference:

महाशय, स'वनय )नवेदन है क मc #बपीन कुमार भारती 'पता $मथलेश 9साद यादव पद ै कमैSटे नर ।।। के पद पर SSE/PW/PRP के अSतगत कायरत हूं। महाशय, मझ ु े
-दनांक 07 -09-2023 को )नयमानस ु ार SSE/PW/PRP के >वारा हमे PME जांच के $लए Sr. DMO/DHN के पास भेजा गया और वहां जाने के बाद Sr. DMO/DHN (Mrs. Topno) के >वारा PME जांच 9 5या भी कया गया ले कन जांच 9 5या के उपरांत उSह.ने बोला क िजस ै कमैन का medical category A2 होता है तो उसका PME 4 वष पर होता है और उSह.ने SSE/PW/PRP को एक पV दे कर मझ ु े SSE/PW/PRP के पास भेजा गया तब SSE/PW/PRP ने उस पV का जवाब दे कर ु े Sr. DMO/DHN के पास भेजा गया। और हम3 30 -दन. तक लगातार इधर से मझ उधर परे शान कया गया और हम3 कसी तरह का फट या अन फट 9माण नह ं ु े Sr. DEN 2/DHN (Suraj Kumar) के >वारा दबाव -दलाकर
-दया गया और मझ ु े वापस काय म3 भेज -दया गया। उसके बाद मc -दनांक 07/10/2024 को मझ मंडल रे ल 9बSधक धनबाद से $मला तो उSह.ने आ Rवासन -दया क तुOहारा ु ार CMS/DHN से $मला तो उSह.ने कहा मेBडकल जांच होगा और उनके )नद* शानस क फर से एक नया PME MEMO लेकर आ इए उसके बाद आ पका PME जांच कया जाएगा। तब SSE/PW/PRP के >वारा -दनांक 09-10-2024 को Sr. DMO/DHN के पास PME जांच के $लए भेजा गया तब वहां जाने के बाद Sr. DMO/DHN (Dr. '9यम 9साद) के पास भेजा गया तब उSह.ने मेरे बारे म3 जानकार लेते हुए फर से एक पV SSE/PW/PRP को -दया क A2 Medical category का PME 4 वष पर ह होता है । तब SSE/PW/PRP उस पV का जवाब भी -दए उसके बाद Sr. DMO/DHN (Dr. '9यम 9साद ने हमे एक पV दे कर PME जांच करने से मना कर -दया और उSह.ने कहा क TRACKMAN का MEDICAL CATEGORY B1 (BEE ONE) होता है और B1 (BEE ONE) MEDICAL CATEGORY का PME 45 वष पर होता है । और हम3 B1(BEE ONE) MEDICAL CATEGORY म3 भी फट नह ं कया गया और हम3 7 -दन. तक PME म3 रखकर कसी 9कार का फट या अन फट 9माण नह ं -दए। जब कL िजस TRACKMAN का MEDICAL CATEGORY A2 और A3 हc उसका PME जांच भी Sr, DMO/DHN के >वारा कया गया है उसका छाया 9)त भी शा$मल कर रहे हc। अतः eीमान से सादर )नवेदन है क उपरो"त बात. को Eयान म3 रखते हुए िजस तरह A2 MEDICAL CATEGORY वाले का PME जांच कया जाता हc उसी 9कार मेरा भी PME जांच कया जाय । और मझ ु े भी फट या अन फट 9माण पV -दया जाए ता क मc तनाव मु"त होकर रे ल पटर पर काय कर सकंू ।"Page 4 of 6
Relevant Facts emerged during Hearing:
The following were present:-
Appellant: Present through video-conference. Respondent: Dr. Arun Kumar Sah, Sr. DMO present through video-conference.
The appellant while reiterating the contents of his averred written submission averred that correct memo of his periodic medical examination (PME) has not been provided to him till date, resultantly, he did not get the entitled service benefits and post like his fellow colleagues.
The respondent stated that point-wise reply has already been provided to the appellant against this RTI application. He further apprised the Commission that during PME the medical category of the appellant vis-à-vis his designation, there was a mismatch. Therefore, his memo for issuance of certificate was returned on the ground that designation of appellant is mentioned as Trackman III under SSE/P.WAY/PRP, and the medical category was shown as A-
2 (Aye Two) whereas the post of trackman actually comes under medical category B-1(Bee-one), in which case as per IRMM chapter 5, Para 514 (B) PME case of B-1 could be done only on the person attaining the age of 45 years. The appellant on the relevant date had not attained that age. Therefore, as per the desire of the appellant it cannot be issued at this premature stage.
Decision:
The Commission after adverting to the facts and circumstances of the case, hearing both the parties and perusal of records finds no infirmity in the reply and as a sequel to it further clarifications tendered by the respondent during hearing as the same were found to be in consonance with the provisions of RTI Act. It is noteworthy that the CPIO is only a communicator of information based on the records held in the office and hence, he is not expected to create information as per the desire of the Appellant. CPIO is also not expected to violate the applicable Rules merely because an application and subsequent appeals under the RTI Act have been filed.Page 5 of 6
Further, the issue flagged by the appellant in this Appeal is a matter of grievance which cannot be resolved under the mandate of the RTI Act. He is at liberty to agitate the matter before the competent forum. Commission does not have jurisdiction to adjudicate grievance matters.
In view of the above, no relief can be granted in the matter.
The appeal is disposed of accordingly.
