This Civil Suit is preferred, under Order IV Rule of The Original Side
Rules read with Order VII Rule 1 of C.P.C. and under Sections 51, 55 and 62 of
the Copyright Act, 1957, praying
a. For a permanent injunction restraining the defendants, their men,
agents, servants, assigns, heirs, representatives,successors,affiliates or any
other persons claiming through/under them from in any manner publicly
performing or communicating the schedule mentioned sound recordings works
of the plaintiff to the public or allowing their premises or any premises under
their control to be used for the said purpose without license from the plaintiff
or in otherwise infringing copyright in any work owned and licensed by the
plaintiff.
b. Costs of the suit; and
c. Pass such further or other orders as this Hon'ble Court may deem fit
and proper in the circumstances of the case and thereby render justice.

JUDGMENT
There is a sole plaintiff and there are three defendants in this suit.
2. Mr.R.Palaniandavan, learned counsel on record for sole plaintiff, Mr.Vishnu Mohan, learned counsel on record for defendant Nos.1 and 2 and Mr.Thriyambak J.Kannan, learned counsel on record for defendant No.3 are before this Commercial Division.
3. Application No.7026 of 2018 has been taken out by plaintiff with a http://www.judis.nic.in 3 prayer for summary judgment in the main suit primarily under Order XIII-A of amended 'The Code of Civil Procedure, 1908' ('C.P.C.' for brevity) as amended by 'The Commercial Courts Act, 2015' ('said Act' for brevity).
4. Plaintiff is a private limited company incorporated under the relevant laws in India and is therefore a juristic person. It is the case of the plaintiff that it was incorporated in 2002 and since its incorporation, it is in the business of issuing licenses and protection of copyrights subsisting in sound recordings of the songs contained in cinematographic films as an assignee, licensee or authorized agent of various copyright holders.
5. As far as the instant suit is concerned, it pertains to copyright in sound recordings in songs in as many as 151 cinematographic films and an enumeration of the same with relevant details are as follows:

6. The aforesaid songs in 151 cinematographic films shall hereinafter be referred to as 'suit movie songs' for the sake of convenience and clarity.
7. Plaintiff submits that it has the authority to give license qua copyright in suit movie songs in its capacity either as assignee, licensee or authorized agent from respective copyright holders.

8. Alleging that the defendants had played the suit movie songs on various dates and that it is infringement of copyright in suit movie songs, instant suit has been filed by plaintiff. Such playing of suit movie songs is referred to as 'On Ground Performance' in industry parlance and the same term/expression is being used in this judgment also for the sake of convenience and clarity.
9. Suffice to say that the instant suit is one claiming injunctive relief qua copyright in suit movie songs. To be precise, plaint is one claiming an injunction restraining the defendants, their men, agents, servants, assigns, heirs, representatives and affiliates from making 'On Ground Performances' qua suit movie songs without getting license from the plaintiff.
10. Prayer paragraph in the plaint is a unnumbered paragraph, which follows paragraph No.32 of the plaint.
11. Learned counsel for plaintiff confirms that the unnumbered paragraph, which follows paragraph No.32 of the plaint, is the prayer paragraph. Prayer paragraph in the plaint reads as follows:
'a. For a permanent injunction restraining the defendants, their men, agents, servants, assigns, heirs, representatives, successors, affiliates or any other persons claiming through/under them from in any manner publicly performing or communicating the http://www.judis.nic.in 25 schedule mentioned sound recordings works of the plaintiff to the public or allowing their premises or any premises under their control to be used for the said purpose without license from the plaintiff or in otherwise infringing copyright in any work owned and licensed by the plaintiff.
b. Costs of the suit; and c. Pass such further or other orders as this Hon'ble Court may deem fit and proper in the circumstances of the case and thereby render justice.'
12. With regard to defendants, from the pleadings in the main suit as well as the pleadings in the aforesaid Interlocutory application No.7026 of 2018, suffice to say that it emerges clearly that it is the stated position of the defendants that they have not made any 'On Ground Performance' of suit movie songs and therefore have not infringed plaintiff's copyright qua suit movie songs. More importantly, it is the stated position of defendants that they do not intend to make any 'On Ground Performance' qua suit movie songs and if they intend to do so in further, they shall obtain permission from the plaintiff.
13. Learned counsel for plaintiff submits that they are satisfied with the aforesaid stated position of defendants. It is under the aforesaid scenario that the aforementioned application being A.No.7026 of 2018 has been taken out with a prayer for summary judgment under Order XIII-A of amended C.P.C. as amended by said Act.

Reacting/responding to the aforesaid application for summary judgment, Mr.Vishnumohan, learned counsel on behalf of defendant Nos.1 and 2 and Mr.Thriyambak J.Kannan, learned counsel on behalf of defendant No.3 point out that in the prayer in the plaint extracted supra, there is a reference to infringement of copyright in any work owned by plaintiff. Both learned counsel point out that this is sweeping and it may be appropriate to restrict the decree in this suit to the suit movie songs [songs in 151 cinematographic films, enumeration of which have been extracted and re-produced supra].
15. Learned counsel for plaintiff also very fairly submits that decree in the instant suit shall govern only the suit movie songs. Therefore suit movie songs are being annexed to the decree as a schedule also.
16. The other point raised by the learned counsel for defendants is that it has to be brought on record that defendants have not infringed the copyright in suit movie songs by any 'On Ground Performance' qua suit movie songs.
17. In the light of the stated position that is now being taken by the defendants, learned counsel for plaintiff submits that this can go on record.
18. The third point projected by two learned counsel for defendants is that this decree should not impede any effort on their part to get license from the plaintiff for 'On Ground Performance' qua suit movie songs.

19. Learned counsel for plaintiff, on instructions, submits that if the defendants approach the plaintiff for copyright/license in suit movie songs, the same will be considered and granted subject of course, to mutual agreement of commercial terms.
20. Therefore, the three points raised by the defendants and the anxiety of the defendants in this regard stand doused. Now that the anxiety of the defendants qua the aforementioned three points stand doused, all the three learned counsel before me submit in unison that it would be appropriate to pass a summary judgment in this suit subject, of course, to the aforesaid three aspects of the matter.
21. Mr.Thiryambak J.Kannan, learned counsel on record for defendant No.3 draws my attention to clause (b) of Sub-rule (1) of Rule 6 as well as Sub-
clause (ii) of clause (a) of Sub-rule (2) of Rule 7 of Order XIII-A. In other words, learned counsel draws my attention to Rules 6(1)(b) and 7(2)(a)(ii) both under Order XIII-A of amended C.P.C. as amended by said Act. I deem it appropriate to extract both these provisions and those provisions read as follows:
'6. Orders that may be made by the Court (1) On an application made under this Order, the Court may make such orders that it may deem fit in its discretion including the following:
(a) ...

(b) conditional order in accordance with Rule 7 mentioned hereunder.
....
7. Conditional order (1).....
(2) Where the Court makes a conditional order, it may_
(a) make it subject to all or any of the following conditions:-
(i) ....
(ii) require a party to take a specified step in relation to the claim or defence, as the case may be;
........'
22. Learned counsel submits that this will be a fit case for passing a decree with the aforesaid three conditions being telescoped/built into it and as there is a reference to license to be granted by plaintiff, if approached, aforementioned Rule 7(2)(a)(ii) is also attracted, is his say.
23. As there is consensus between all the three learned counsel on these aspects of the matter, this main suit itself is disposed of by this summary judgment without resorting to oral evidence. To be noted, all the three learned counsel before me submit that there is no impediment and or there is no other reason which impedes the passing of such summary judgment.

24. A summary judgment /decree is passed on the following terms:
(a) There shall be a permanent injunction restraining the defendants, their men, agents, servants, assigns, heirs, representatives, successors, affiliates or any other persons claiming through/under them from in any manner publicly performing or communicating the suit movie songs i.e., sound recordings in 151 movies, which have been extracted/reproduced supra besides being set out in the schedule to this decree.
(b) If defendants choose to make any 'On Ground Performance' qua suit movie songs [referred to schedule annexed to the decree], they shall approach the plaintiff for license and plaintiff shall grant license i.e., copyright on mutually agreed commercial terms. Though obvious, it is made clear that this decree will not come in the way in such a course being adopted.
(c) The stated position of the defendants that they have not made any 'On Ground Performance' of suit movies songs and have therefore not infringed the copyright of the plaintiff qua suit movie songs is taken on record.

(d) This decree i.e., injunctive decree is restricted to suit movie songs [enumeration of which have been made in schedule to decree] and that limb of the prayer pertaining to copyright in other work owned by the plaintiff is obviously outside the scope of this decree.
(e) In the light of the trajectory of this hearing , there shall be no order as to costs.
25. Suit is decreed on above terms. Consequently, connected miscellaneous petition is closed.
